【摘要】：貨幣以其價(jià)值尺度、流通手段等基本職能創(chuàng)造了現(xiàn)代社會的商品交換世界。作為現(xiàn)代社會秩序維系的核心要素,貨幣既是人類個(gè)體從主觀世界走向客觀世界的中介環(huán)節(jié),又是國家規(guī)范秩序和治理體系的關(guān)鍵所在。貨幣既是公私法規(guī)范體系產(chǎn)生發(fā)展的秘密,也是公民權(quán)利和國家權(quán)力緊張關(guān)系的聚焦中心。在權(quán)利和權(quán)力的合作競爭中,去除金銀本位的國家紙幣體系應(yīng)當(dāng)遵循貨幣運(yùn)動的內(nèi)在倫理邊界,尋求貨幣權(quán)力和貨幣財(cái)產(chǎn)權(quán)之間的和解,通過貨幣治理法治化,以貨幣民主、貨幣非國家化等規(guī)范框架限制貨幣走向極權(quán)的可能性。
[Abstract]:Currency has created the world of commodity exchange in modern society with its basic functions such as value measure and circulation means. As the core element of the maintenance of modern social order, money is not only the intermediary link from the subjective world to the objective world, but also the key to the national normative order and governance system. Money is not only the secret of the development of the system of public and private law, but also the focus of the tension between civil rights and state power. In the cooperation and competition of right and power, the national paper money system with the removal of gold and silver standard should follow the intrinsic ethical boundary of monetary movement, seek the reconciliation between monetary power and monetary property right, and rule by law through monetary governance and monetary democracy. Monetary non-nationalization and other normative frameworks limit the possibility of currency moving towards totalitarianism.
