【摘要】：調(diào)解制度在我國有著悠久的歷史,它根植于我國傳統(tǒng)文化的土壤,是一種有效的糾紛解決機制。調(diào)解離不開語言,它是一種用語言來進(jìn)行的活動,調(diào)解中語言的運用情況往往決定著調(diào)解的成功與失敗。因此,相對于調(diào)解制度在我國的重要性以及語言本身在調(diào)解中的重要性而言,研究調(diào)解語言十分必要。在某種意義上,研究調(diào)解語言本身就是對調(diào)解實踐的最直接而有效的研究。 本文以調(diào)解語言為研究對象,對調(diào)解語言運用的文化背景、語言運用藝術(shù)以及調(diào)解中非語言交際手段等進(jìn)行探討,旨在通過以法學(xué)為基礎(chǔ),結(jié)合語言學(xué)、心理學(xué)等學(xué)科的知識進(jìn)行交叉學(xué)科的研究,探討如何在調(diào)解實踐中提高語言運用能力,從而提高調(diào)解能力,繼而提高調(diào)解成功的幾率。本文除了引言和結(jié)論外,主體部分由三章組成。 引言部分,闡述了調(diào)解語言的研究現(xiàn)狀、本文寫作的意義與方法。一方面,通過對調(diào)解語言研究現(xiàn)狀的綜述與分析,指出本文研究的理論意義和實踐意義。另一方面,介紹了本文個案分析的研究方法、描述性的研究方法和交叉學(xué)科的研究方法, 第一章,闡述了我國源遠(yuǎn)流長的調(diào)解制度。從調(diào)解的文化背景出發(fā),介紹了傳統(tǒng)調(diào)解制度中特有的“調(diào)人”與當(dāng)今調(diào)解制度中的法院調(diào)解及民間調(diào)解現(xiàn)象,簡要描述了“調(diào)人”的演變及其在調(diào)解中的作用,指出“調(diào)人”和當(dāng)今調(diào)解人在調(diào)解中是通過運用語言來化解糾紛的事實;文章進(jìn)而探討調(diào)解與語言的關(guān)系,分析指出語言具有調(diào)解的功能,并在現(xiàn)代漢語有著深厚的文化積淀,形成了特有的調(diào)解語言現(xiàn)象。而在調(diào)解實踐中,語言確實發(fā)揮著舉足輕重的作用,調(diào)解人的語言運用能力直接影響著調(diào)解的成功幾率。因此,探討調(diào)解中的語言藝術(shù)就顯得十分必要。 第二章,主要探討了調(diào)解語言藝術(shù)。在調(diào)解實踐中要注重綜合考量“法”“理”“情”這三個方面,而調(diào)解語言的運用則要根據(jù)糾紛的具體情況而具有一定的原則性和策略性,本章進(jìn)而闡述了調(diào)解能力與調(diào)解語言運用能力之間的關(guān)系,指出提高調(diào)解語言運用能力必須注意調(diào)解技巧的選擇,在調(diào)解過程中要把口頭用語與書面用語相結(jié)合、自身語言與他人語言相結(jié)合,從而充分發(fā)揮主觀能動性來促成調(diào)解。本章輔以三個典型調(diào)解案例,通過對個案的分析可以看出:調(diào)解人之所以能針對性的運用調(diào)解語言成功化解糾紛,大多是憑借他們在實踐中慢慢摸索的經(jīng)驗,而他們可能已經(jīng)意識到調(diào)解成功要具備相關(guān)學(xué)科的素養(yǎng),但卻并不具備相關(guān)學(xué)科的系統(tǒng)知識,如語言學(xué)、心理學(xué)知識等。最后指出,調(diào)解人必須具備相關(guān)的學(xué)科素養(yǎng),方能真正提高調(diào)解語言運用能力,從而提高調(diào)解能力。 第三章,探討了調(diào)解實踐中的非語言交際手段,具體包括體態(tài)語、副語言和時空控制。非語言交際手段在調(diào)解實踐中有著特殊而微妙的作用。調(diào)解過程本身作為一個交際過程,其是否能夠有效完成,還依賴于調(diào)解中非語言交際手段的運用。調(diào)解人只有靈活適時地運用非語言交際手段,如調(diào)解人員注意把握調(diào)解中體態(tài)語、副語言和時空控制的運用等,才能及時有效地化解糾紛,做到案結(jié)事了。 結(jié)論部分,就如何提高調(diào)解語言運用能力進(jìn)行了總結(jié)。同時指出,語言的智慧和技巧來自實踐的磨礪和經(jīng)驗的積累。相對于調(diào)解語言本身的趣味性及其在調(diào)解中的重要性而言,調(diào)解語言仍然具有研究的空間。在受傳統(tǒng)文化影響且具有調(diào)解傳統(tǒng)的我國,調(diào)解語言研究有著重要的實踐意義。
[Abstract]:Mediation system has a long history in our country. It is rooted in the soil of traditional culture in our country. It is an effective dispute settlement mechanism. Mediation can not be separated from language. It is a kind of activities carried out in language. The application of language in mediation often determines the success and failure of mediation. Therefore, it is important to the mediation system in our country. In terms of the importance of the language and the language itself in mediation, it is necessary to study the mediating language. In a sense, the study of the mediating language itself is the most direct and effective study of the practice of mediation.
This paper, taking the mediation language as the research object, discusses the cultural background of the use of the mediation language, the art of language use and the means of non language communication in mediation. The purpose of this study is to study how to improve the use of language in the practice of mediation on the basis of Jurisprudence and combining the knowledge of linguistics, psychology and other disciplines. In addition to the introduction and conclusion, the main body consists of three chapters.
In the introduction part, the research status of mediation language and the meaning and method of this paper are expounded. On the one hand, the theoretical and practical significance of the research are pointed out through the summary and analysis of the research status of the mediation language. The first chapter expounds the long - standing mediation system in our country. From the cultural background of mediation, it introduces the mediation and civil mediation in the traditional mediation system and the current mediation system, briefly describes the evolution of the "mediation" and its role in mediation, and points out that the "mediation" and the modem mediator are in the mediation system. The second chapter mainly discusses the art of mediation language. In the practice of mediation, we should pay attention to the three aspects of the comprehensive examination of "law", "reason" and "emotion", while the application of the mediation language has a certain principle and strategy according to the specific situation of the dispute, and this chapter expounds the relationship between the ability of the mediation and the ability to use the mediation language. It is pointed out that it is necessary to pay attention to the choice of mediation skills to improve the ability to use the mediation language. In the process of mediation, it is necessary to combine the oral language with the written language, and combine the language with the other's language, so as to give full play to the subjective initiative to facilitate the mediation. This chapter is supplemented by three typical cases of mediation. Through the analysis of the case, we can see that mediation The reason why people can successfully resolve disputes by using the mediation language is mostly by their experience in practice, and they may have realized that the success of the mediation should have the quality of the related disciplines, but they do not have systematic knowledge of relevant disciplines, such as language and psychology. Finally, the mediator must With the relevant discipline accomplishment, we can really improve the ability of mediation language and enhance the ability of mediation.
The third chapter discusses the non-verbal communication means in the practice of mediation, including body language, paralanguage and time and space control. Nonverbal communication has a special and subtle role in mediation practice. As a communicative process, the process of mediation itself can be effectively completed, and it also depends on the use of non-verbal communication means in mediation. Only with the flexible and timely use of non-verbal communication means, the mediators, such as the mediator's attention to the body language in mediation, the use of paralanguage and the use of space-time control, can resolve disputes in time and effectively, and do the case.
The conclusion is a summary of how to improve the ability to use the mediation language. At the same time, it is pointed out that the wisdom and skill of language comes from the practice and the accumulation of experience. As to the interest of mediating language itself and its importance in mediation, the language of mediation still has a research space. In traditional China, the study of mediation language is of great practical significance.
