【摘要】：法律解釋的歷史與法律本身的歷史幾乎一樣悠久，而作為一門古老而歷久彌新的學(xué)科，法律解釋在當(dāng)今日新月異的新語境下，更加凸顯其重要性。一方面，它強(qiáng)調(diào)對(duì)法律實(shí)踐的反思，另一方面，它站在本體論的立場(chǎng)上，尋求著法律解釋在法律適用中的規(guī)則運(yùn)用和法律真理性的認(rèn)知。除英國(guó)法律解釋中三大聞名遐邇的解釋規(guī)則以外，法律解釋學(xué)經(jīng)過進(jìn)一步發(fā)展，其他幾種主要法律解釋規(guī)則也逐步為人所熟知。本文將選取理解原則（Comprehension Rule）和平義原則（PlainMeaning Rule）作為分析的切入路徑，通過對(duì)比的研究的方法，尋法律解釋和法律翻譯之間的同異，探索法律解釋原則對(duì)于法律翻譯的啟示。 法律翻譯是譯者的消化和重建過程，它通過對(duì)法律文本的理解和掌握，在充分發(fā)揮譯者能動(dòng)性的前提下，對(duì)翻譯主體的法律意蘊(yùn)進(jìn)行語言間的轉(zhuǎn)換。雖然法律解釋常在法律領(lǐng)域被研究，而法律翻譯多由語言領(lǐng)域所垂青，但二者在文本理解方面都強(qiáng)調(diào)理解法律的過程。 法律解釋和法律翻譯，前者是單語間的意義轉(zhuǎn)換，后者是雙語或者多語的表達(dá)過程。前者的實(shí)現(xiàn)更多是由法官來完成，而后者多是譯者和其他涉及雙語及多語的法律人完成。上世紀(jì)七十年代以來，，對(duì)于法律解釋的研究使得法律解釋的精髓擴(kuò)大到其他交叉領(lǐng)域，我國(guó)對(duì)于法律解釋和法律翻譯的比較研究也方興未艾。 本文首先對(duì)法律解釋和法律翻譯現(xiàn)狀做出簡(jiǎn)單描述，比較兩者同異之處，而后詳細(xì)分析平意原則和理解原則，在深刻剖析法律解釋規(guī)則發(fā)展的同時(shí)，對(duì)法律翻譯現(xiàn)狀進(jìn)行分析，亦對(duì)比分析法律解釋規(guī)則和法律翻譯兩者間的關(guān)聯(lián)，進(jìn)而尋找法律翻譯理論拓展的視角，力圖在突破語言翻譯理論禁錮的同時(shí)，期�；貧w法律翻譯的正確理論導(dǎo)向和在合理基礎(chǔ)上的法律翻譯策略。
[Abstract]:The history of legal interpretation is almost as long as the history of law itself. On the one hand, it emphasizes the reflection on legal practice, on the other hand, it seeks the application of rules and the cognition of legal truth in the application of law from the standpoint of ontology. In addition to the three famous rules of interpretation in English legal interpretation, legal hermeneutics has been further developed, and several other major rules of legal interpretation have gradually become well known. In this paper, the author chooses the principle of comprehension Rule and the principle of peaceful meaning as the path of analysis, finds the similarities and differences between legal interpretation and legal translation, and explores the enlightenment of the principle of legal interpretation to legal translation. Legal translation is the process of translator's digestion and reconstruction. Through understanding and mastering the legal text, legal translation can transform the legal meaning of the subject of translation into different languages on the premise of giving full play to the translator's initiative. Although legal interpretation is often studied in the field of law and legal translation is favored by the field of language, both of them emphasize the process of understanding law in the aspect of text understanding. Legal interpretation and legal translation, the former is a monolingual meaning conversion, the latter is a bilingual or multilingual process of expression. The former is more accomplished by judges, while the latter by translators and other legal practitioners involved in bilingualism and multilingualism. Since the 1970s, the essence of legal interpretation has been expanded to other intersecting fields, and the comparative study of legal interpretation and legal translation in China is in the ascendant. This paper first gives a brief description of the current situation of legal interpretation and legal translation, compares the similarities and differences between the two, and then analyzes in detail the principles of equality and understanding, and analyzes the current situation of legal translation while deeply analyzing the development of the rules of legal interpretation. It also makes a comparative analysis of the relationship between the rules of legal interpretation and legal translation in order to explore the perspective of the expansion of legal translation theory in order to break through the confinement of language translation theory at the same time. Shi Xi returns to the correct theoretical orientation of legal translation and the strategy of legal translation on a reasonable basis.
