【摘要】：中國特色社會主義法治道路呈現(xiàn)鮮明的"中國特色",從而體現(xiàn)出明顯的獨(dú)特性。從"三個獨(dú)特"即獨(dú)特的文化傳統(tǒng)、獨(dú)特的歷史命運(yùn)、獨(dú)特的基本國情角度闡發(fā)中國特色社會主義法治道路具有重要的理論價值,有助于正確認(rèn)識法治道路的唯一性與多樣性的關(guān)系、中國法治道路的"獨(dú)特性"與人類法治"一般性"的關(guān)系。中國特色社會主義法治道路的獨(dú)特性具體體現(xiàn)在三個方面:實(shí)現(xiàn)方式上具有強(qiáng)烈的頂層推動特征;方法手段上具有獨(dú)特的德法互補(bǔ)特征;發(fā)展途徑上具有明顯的漸進(jìn)穩(wěn)健特征。其內(nèi)在根據(jù)是:歷史慣性和實(shí)踐證明了頂層推動的必要性;中華文化為"德""法"融合提供了深厚的土壤;現(xiàn)實(shí)國情要求法治建設(shè)必須漸進(jìn)穩(wěn)健。從中可以進(jìn)一步看出研究中國特色社會主義法治道路的方法論問題,即要從中國的客觀實(shí)際而不是抽象的理論出發(fā);要從中國道路整體性而不是單純的法學(xué)角度出發(fā)。
[Abstract]:The rule of law road of socialism with Chinese characteristics presents distinct "Chinese characteristics", thus reflecting its distinct uniqueness. It is of great theoretical value to explain the road of socialist rule of law with Chinese characteristics from the angle of "three unique" that is, unique cultural tradition, unique historical destiny and unique basic national conditions. It is helpful to correctly understand the relationship between uniqueness and diversity of the road of rule of law, and the relationship between "uniqueness" of the road of rule of law in China and "generality" of human rule of law. The uniqueness of the road of rule of law of socialism with Chinese characteristics is embodied in three aspects: the way of realization has strong top-level driving characteristics, the method and means have unique characteristics of complementation of Germany and France, and the way of development has the characteristic of gradual steadiness. Its internal basis is: historical inertia and practice prove the necessity of top-level promotion; Chinese culture provides a deep soil for the integration of "morality" and "law"; the actual situation requires that the construction of the rule of law must be gradual and steady. It can be further seen that the methodology of studying the road of ruling by law with Chinese characteristics should be based on the objective reality of China rather than the abstract theory, and from the perspective of the integrity of the Chinese road rather than the purely legal point of view.
