【摘要】：政府主導(dǎo)法治建設(shè),這是我國(guó)法治建設(shè)的基本特點(diǎn)和模式,區(qū)域法治建設(shè)同樣不能擺脫這一模式。在承認(rèn)政府對(duì)區(qū)域法治建設(shè)重要意義的同時(shí),我們也應(yīng)當(dāng)看到政府功能的局限性。政府主導(dǎo)型的法治建設(shè)將政府置于一種兩難境地,與新公共治理理念相悖,容易導(dǎo)致“國(guó)家法制主義”現(xiàn)象的出現(xiàn),忽視其他社會(huì)規(guī)范的作用。重構(gòu)政府在區(qū)域法治建設(shè)中的作用,要求政府的法治化定位,實(shí)施任何行為都應(yīng)當(dāng)有法可依。政府還應(yīng)培育社會(huì)組織,有效反映公眾意見(jiàn),并且意識(shí)到政府自身及國(guó)家制定法的局限,注重發(fā)揮其他社會(huì)主體和社會(huì)規(guī)范的作用。
[Abstract]:The government leads the construction of the rule of law, which is the basic characteristic and mode of the construction of the rule of law in our country.While acknowledging the importance of government to the construction of regional rule of law, we should also recognize the limitation of government function.The government-led construction of the rule of law puts the government in a dilemma, which runs counter to the idea of new public governance and easily leads to the appearance of "national legalism" and neglects the role of other social norms.Reconstructing the role of government in the construction of regional rule of law requires the orientation of the government to rule by law, and any action should be carried out in accordance with the law.The government should also cultivate social organizations, effectively reflect public opinions, and realize the limitations of government and national laws, and pay attention to the role of other social subjects and social norms.
