【摘要】：借用"話語"這一概念,道德話語、政治話語、法律話語可定義為當代中國糾紛解決的三種主要話語。在社會轉型期,以"纏訟"與"涉訴信訪"的實證研究為例,三種話語在糾紛解決的"官方表達"與"日常實踐"兩種情境中表現(xiàn)出"應然"與"實然"之間的"關系錯位",政治話語、道德話語往往會"逆襲"至法律話語之上進行定紛止爭,導致了大量"非法治現(xiàn)象"的出現(xiàn)。"話語逆襲",不僅是大眾主義與精英主義兩種對立的法治建設理念的產(chǎn)物,更是國家政權建設與現(xiàn)代法治建設之間不對等權力關系的表征。站在民族國家歷史、文化、政治發(fā)展的角度理性審視這種現(xiàn)象,突破"規(guī)范式的西方中心主義",在文化自覺的基礎上探尋"道德話語"、"政治話語"、"法律話語"之間的關系協(xié)同與權威配置,是探索"中國式法治"建設道路的關鍵所在。
[Abstract]:Using the concept of "discourse", moral discourse, political discourse and legal discourse can be defined as the three main discourses of dispute resolution in contemporary China.In the period of social transformation, the empirical study of "litigation" and "complaint petition" is taken as an example.In the two situations of "official expression" and "daily practice" of dispute resolution, the three kinds of discourse show "relationship dislocation" between "ought" and "reality", and political discourse.Moral discourse often "counterattacks" to the legal discourse to resolve disputes, resulting in a large number of "non-rule of law phenomenon.""discourse counterattack" is not only the product of the two opposing ideas of populism and elitist, but also the representation of the unequal power relationship between the construction of state power and the construction of modern rule of law.From the perspective of the history, culture, and political development of nation-states, we should examine this phenomenon rationally.The key to explore the construction of "Chinese rule of law" is to break through the "normative western centrism" and explore the relationship between "moral discourse", "political discourse" and "legal discourse" on the basis of cultural consciousness.
