【摘要】：以TPP為代表的國際經(jīng)貿(mào)新規(guī)則一方面在投資、金融、服務(wù)貿(mào)易領(lǐng)域強(qiáng)調(diào)放松管制,另一方面則加強(qiáng)對(duì)勞工標(biāo)準(zhǔn)、環(huán)境、公平競(jìng)爭(zhēng)的有效監(jiān)管。上海自貿(mào)區(qū)的法治建設(shè)體現(xiàn)了主動(dòng)與國際經(jīng)貿(mào)新規(guī)則對(duì)接的特點(diǎn)。然而,在權(quán)威的立法依據(jù)、地方立法與部委規(guī)章之間的關(guān)系、對(duì)抽象性行政行為的司法審查、加強(qiáng)司法審判中的商事思維、加大自貿(mào)區(qū)地方立法中使用國際通行規(guī)則的表述等問題上,仍需要深入思考,在法治框架下找到合理解決方案。
[Abstract]:The new international trade rules represented by TPP on the one hand, investment, financial service trade, stressing deregulation, on the other hand, to strengthen the environment on labor standards, effective supervision, fair competition. Shanghai free trade area of the construction of the rule of law embodies the characteristics of active and new rules of international trade docking. However, in the legislative basis of authority and the relationship between the local legislation and regulations of ministries, judicial review of abstract administrative behavior, strengthen commercial thinking in justice, increase the use of international rules of the FTA in the local legislation formulation, still need to think deeply, to find a reasonable solution in the framework of the rule of law.
