【摘要】：隨著我國(guó)法律體系的基本完善和逐漸重視建設(shè)社會(huì)主義法治國(guó)家、依法治國(guó)。如何構(gòu)建一個(gè)與我國(guó)社會(huì)主義法治建設(shè)相適應(yīng)的法律文化是一個(gè)重要的問(wèn)題。而若要建立一個(gè)時(shí)候我國(guó)的法律文化，就需要考察本國(guó)的文化和法律發(fā)展的歷史，，研究傳統(tǒng)法律文化。然而我國(guó)傳統(tǒng)法律文化不但形成時(shí)間長(zhǎng)而且內(nèi)涵極其豐富。雖然其中存在著一些違反現(xiàn)代法律精神的內(nèi)容，但是仍留著大量的積極有益的內(nèi)容，因此我們不能全盤(pán)否定幾千年來(lái)形成的傳統(tǒng)法律文化，而是應(yīng)當(dāng)在學(xué)習(xí)、借鑒西方法律文化的同時(shí)繼承發(fā)展我國(guó)傳統(tǒng)法律文化，以達(dá)到構(gòu)建我國(guó)社會(huì)主義法治建設(shè)的目標(biāo)。 本文第一部分介紹相關(guān)的概念，通過(guò)對(duì)概念的解析明確研究的問(wèn)題。第二部分主要介紹我國(guó)傳統(tǒng)法律文化發(fā)展的歷史和特征，以期能夠?qū)ξ覈?guó)傳統(tǒng)法律思想有一個(gè)概括性的把握。第三部分介紹我國(guó)傳統(tǒng)法律文化對(duì)我國(guó)現(xiàn)代法治建設(shè)的影響，通過(guò)對(duì)積極影響和消極影響兩方面的介紹可以清楚的看到我國(guó)傳統(tǒng)法律文化在現(xiàn)代法治建設(shè)中的價(jià)值和作用，第四部分就是簡(jiǎn)要的對(duì)我國(guó)傳統(tǒng)法律文化如何進(jìn)行適應(yīng)現(xiàn)代法治社會(huì)的改造，使其可以為我國(guó)現(xiàn)代化法治建設(shè)提供力量。
[Abstract]:With the basic improvement of our legal system and gradually attach importance to the building of a socialist country ruled by law, rule of law.How to construct a legal culture suitable to the construction of socialist rule of law in our country is an important issue.If we want to establish the legal culture of our country, we should investigate the history of our country's culture and law development and study the traditional legal culture.However, China's traditional legal culture not only formed for a long time, and the connotation is extremely rich.Although there are some contents that are contrary to the spirit of modern law, there is still a great deal of positive and beneficial content. Therefore, we should not completely negate the traditional legal culture which has been formed for thousands of years, but should learn from it.We should learn from the western legal culture and inherit and develop our traditional legal culture in order to achieve the goal of building the socialist rule of law in our country.The first part of this paper introduces the related concepts, through the analysis of the concept of a clear study of the problem.The second part mainly introduces the history and characteristics of the development of Chinese traditional legal culture in order to have a general grasp of our traditional legal thought.The third part introduces the influence of Chinese traditional legal culture on the construction of modern rule of law in our country. Through the introduction of positive and negative influence, we can clearly see the value and function of Chinese traditional legal culture in the construction of modern rule of law.The fourth part is how to adapt the traditional legal culture of our country to the transformation of the modern society of rule of law so that it can provide the strength for the construction of the modern rule of law in our country.
