【摘要】：立法聽證制度起源于西方國(guó)家，作為提高立法科學(xué)性和民主性的重要制度，已被我國(guó)《立法法》第34條和第58條正式確立。本文緒論介紹了選題背景、國(guó)內(nèi)外立法聽證的研究現(xiàn)狀、研究的思路和方法等。第二章從立法聽證相關(guān)概念的界定入手，介紹了立法聽證制度的概念和功能等基本理論。第三章從社會(huì)主義市場(chǎng)經(jīng)濟(jì)、民主政治以及依法治國(guó)三個(gè)方面分析了我國(guó)建立立法聽證制度的背景原因，指出其在我國(guó)建立的必然性，并從國(guó)家和地方兩個(gè)層面對(duì)立法聽證在我國(guó)的實(shí)踐情況進(jìn)行了總結(jié)和歸納，其中著重介紹了廣州立法聽證的開展?fàn)顩r。第四章則以我國(guó)地方的立法聽證規(guī)則和實(shí)踐為研究對(duì)象，運(yùn)用文獻(xiàn)研究、系統(tǒng)分析等方法，具體分析了我國(guó)立法聽證制度在聽證規(guī)則制定和實(shí)踐操作中存在的問題及原因。第五章則以提高立法聽證的效果為目的，在介紹和借鑒國(guó)外經(jīng)驗(yàn)的基礎(chǔ)上對(duì)我國(guó)立法聽證的完善提出了具有實(shí)操性的建議。
[Abstract]:Legislative hearing system originated in western countries, as an important system to improve the scientific and democratic nature of legislation, it has been formally established by articles 34 and 58 of the Legislative Law of our country.This paper introduces the background of the topic, the status quo of the legislative hearing at home and abroad, the ideas and methods of the research.The second chapter begins with the definition of the related concepts of the legislative hearing, and introduces the basic theories of the legislative hearing system, such as the concept and function of the legislative hearing system.The third chapter analyzes the background reasons of the establishment of legislative hearing system in China from three aspects of socialist market economy, democratic politics and rule of law, and points out the inevitability of its establishment in China.The author summarizes and summarizes the practice of the legislative hearing in our country from the national and local levels, and emphatically introduces the development of the legislative hearing in Guangzhou.The fourth chapter takes the local legislative hearing rules and practice as the research object, using the methods of literature research and systematic analysis, analyzes the problems and causes of the legislative hearing system in the making and practice of the hearing rules in our country.The fifth chapter aims at improving the effect of the legislative hearing, and puts forward some practical suggestions on the perfection of the legislative hearing in our country on the basis of introducing and drawing on the experience of foreign countries.
