【摘要】：老年人監(jiān)護制度是我國應(yīng)對老齡化挑戰(zhàn)的手段之一。高齡獨居、患有慢性病和失能的老年人發(fā)生悲劇事件的現(xiàn)象已經(jīng)屢見不鮮,老年人監(jiān)護制度能夠在一定程度上防止類似事件的發(fā)生。許多老年人存在被監(jiān)護的需求,但是并不符合現(xiàn)有法律規(guī)定的被監(jiān)護的條件而不能得到監(jiān)護。我國立法規(guī)定,除老年人的意定監(jiān)護外,只有患有精神病的老年人是受監(jiān)護法律保護的,并且涵蓋在精神病患者監(jiān)護立法中,適用精神病患者監(jiān)護立法的規(guī)定。在實踐中,精神病鑒定存在不足之處,如鑒定機構(gòu)的業(yè)務(wù)范圍不能涵蓋老年人監(jiān)護評價的需求、鑒定機構(gòu)設(shè)置不統(tǒng)一、鑒定人員資質(zhì)未統(tǒng)一、鑒定程序不完善�；诿绹慕�(jīng)驗與啟示,構(gòu)建我國老年人監(jiān)護評價機構(gòu)可以由受理與審查部門、評定部門完成,并配套相應(yīng)的經(jīng)費:居民或村民委員會是我國基層群眾性自治組織,其作為老年人監(jiān)護評價機構(gòu)的受理與審查部門是不二的路徑選擇;我國可以在律師協(xié)會之中設(shè)立老年人法律委員會,在心理學會中設(shè)立老年人心理委員會;老年人法律委員會成員、老年人心理委員會成員與精神病鑒定人員組成評定隊伍,評定部門的運行由當?shù)氐睦淆g辦協(xié)調(diào)各組成單位完成。
[Abstract]:The system of guardianship of the elderly is one of the means to deal with the challenge of aging in our country.It is not uncommon for the elderly who live alone and suffer from chronic diseases and disability to have tragic events, and the guardianship system for the elderly can prevent the occurrence of similar events to a certain extent.Many older people have a need for guardianship, but do not meet the existing legal conditions for guardianship.According to the legislation of our country, only the elderly suffering from mental illness are protected by guardianship law, and they are covered in the legislation of guardianship of mental patients, which is applicable to the regulation of guardianship of mental patients.In practice, there are shortcomings in psychiatric appraisal, such as the scope of the appraisal institution can not cover the needs of the elderly guardianship evaluation, the establishment of the appraisal institution is not uniform, the qualification of the appraiser is not uniform, and the appraisal procedure is not perfect.Based on the experience and inspiration of the United States, the establishment of the elderly guardianship and evaluation organization in China can be completed by the acceptance and examination department, the evaluation department and the corresponding funds: the residents or villagers' committee is the grass-roots mass autonomous organization in our country.It is a necessary path choice for the department of accepting and examining as the institution of the guardianship evaluation of the elderly, the law committee for the elderly can be set up in the bar association, the psychological committee for the elderly can be set up in the psychological society in our country;The members of the legal Committee for the elderly, the members of the Psychological Committee for the elderly and the psychiatrists formed the assessment team, and the operation of the evaluation department was completed by the local aging office coordinating the various constituent units.
