【摘要】：科技進(jìn)步及其推進(jìn)的產(chǎn)業(yè)革命為中國刑法的近現(xiàn)代革命提供了物質(zhì)技術(shù)支撐。罪刑法定原則的確立,得益于因信息科技發(fā)展而改進(jìn)的立法技術(shù)和普法手段;軍事現(xiàn)代化基本化解了造反和叛亂的風(fēng)險,從而減輕了國家對酷刑和株連的依賴;加之,發(fā)達(dá)的偵查技術(shù)提高了案件破案率,雄厚的財政預(yù)算支持了監(jiān)獄的改良,刑罰由此趨于人道。此外,國家能力的提升也拓展了刑法的控制領(lǐng)域并削弱了的權(quán)貴階層的特權(quán)�？傊�,軍力、警力和財政等巨大變量的強(qiáng)力介入,改變了法律決策者對傳統(tǒng)法律兩難問題的利弊權(quán)衡。
[Abstract]:The progress of science and technology and the industrial revolution promoted by it have provided material and technical support for the modern revolution of Chinese criminal law. The establishment of the principle of legally prescribed punishment for a crime has benefited from the legislative technology and legal popularization means improved by the development of information technology. The modernization of the military has basically eliminated the risks of rebellion and rebellion, thereby reducing the country's dependence on torture and company; in addition, developed investigative techniques have increased the rate of detection of cases, and a strong financial budget has supported the improvement of prisons. In addition, the improvement of state capacity has also expanded the field of criminal law control and weakened the privileges of the powerful class.
