【摘要】：法治路徑是保障和實現(xiàn)綠色發(fā)展的重要選擇。法治思維為國家治理注入了良法的基本價值,法治方式為國家治理提供了善治的創(chuàng)新機制,綠色發(fā)展的法治路徑必須要遵循良法善治的法治內(nèi)涵。具體來說,首先,綠色發(fā)展應以人與自然和諧共生的良法理念為指導,有計劃的協(xié)調(diào)整合相關法律法規(guī),形成一整套協(xié)作配合的綠色發(fā)展法律制度體系。其次,通過國家治理能力法治化實現(xiàn)綠色發(fā)展,不僅要依法整合明晰政府部門的綠色發(fā)展職能,建設依法治理的服務型政府,同時還要堅持多元化主體協(xié)同推進綠色發(fā)展。另外,健全綠色發(fā)展的相關法制體系。綠色發(fā)展的法制體系不僅包括嚴格的源頭保護法制體系、過程嚴管法制體系、后果嚴懲法制體系,更要建立健全有利于綠色發(fā)展的市場引導法制體系。最后,完善環(huán)境司法專門化體系建設,并通過不同形式的環(huán)境司法聯(lián)動健全環(huán)境資源審判和監(jiān)督制度體系。
[Abstract]:The path of the rule of law is an important choice to guarantee and realize the green development. The thinking of rule by law infuses the basic value of good law into the governance of the country, and the way of rule of law provides the innovative mechanism of good governance for the governance of the country. The legal path of green development must follow the connotation of good law and good governance. Firstly, green development should be guided by the idea of harmonious coexistence between man and nature, and coordinate and integrate relevant laws and regulations in a planned way. Form a set of coordinated green development legal systems. Secondly, to achieve green development through the legalization of national governance capacity, we should not only integrate and clarify the green development functions of government departments according to law, but also build a service-oriented government governed by law. In addition, to improve the legal system of green development, the legal system of green development not only includes strictly protecting the legal system at the source, but also strictly governing the legal system in the process. The legal system with severe consequences must be severely punished. Moreover, it is necessary to establish and improve the legal system of market guidance that is conducive to green development. Finally, we should improve the construction of the specialized system of environmental justice. And improve the system of environmental resources trial and supervision through different forms of environmental justice linkage.
