【摘要】：“法與時轉(zhuǎn)則治，，法與時宜則有功”。作為調(diào)整社會關(guān)系的法，必須與時俱進，通過與經(jīng)濟社會發(fā)展相適應(yīng)而體現(xiàn)其生命力和科學(xué)性，必須保證其系統(tǒng)內(nèi)部的協(xié)調(diào)統(tǒng)一以維持其約束力和權(quán)威性�；诜ǖ那謇砟軌�?qū)崿F(xiàn)此目的的諸多良性功能，我國不同層面的法律、法規(guī)、規(guī)章清理工作從未間斷，為形成中國特色社會主義法律體系發(fā)揮了重大且積極地作用，但同時也因制度的缺陷和實踐的誤區(qū)存在著若干瑕疵。 本文以2008年-2010年法的清理過程和結(jié)果為研究對象，以此次集中清理工作中收集的數(shù)據(jù)為藍本，結(jié)合定性分析和定量分析的寫作方法，從理論和實證兩方面梳理、證明了此次法的清理完成了既定目標(biāo)，發(fā)揮了積極價值；也在梳理過程中得出了法的清理不會隨中國特色社會主義法律體系的形成而消弭，反而會因成文法的消極價值的內(nèi)在屬性、“一元兩級多層次”的立法體制和完善中國特色社會主義法律體系的工作重心轉(zhuǎn)移等外在因素而愈發(fā)變得重要。 本文分為三部分。第一部分分析了法的清理工作的啟動背景和發(fā)展脈絡(luò)、組織機構(gòu)和實施步驟、對象選擇和處理方式、技術(shù)創(chuàng)新和形式拓展。第二部分對被清理法律法規(guī)的數(shù)量、原因、類別和生命周期等進行了考察和分析。第三部分結(jié)語部分指出，此次法的清理實現(xiàn)了維護法制統(tǒng)一消除法律法規(guī)“硬傷”的目的和功能，保證了中國特色社會主義法律體系的如期形成。在法的清理成為立法工作重要內(nèi)容的背景下，法的清理不可或缺，應(yīng)實現(xiàn)法的清理的理念變革，盡快建立法的清理的常態(tài)化機制。
[Abstract]:As a law to adjust social relations, we must keep pace with the times, and reflect its vitality and scientific nature by adapting to the economic and social development. It is necessary to ensure the coordination and unification within its system in order to maintain its binding force and authoritativeness. The clean-up of laws, regulations and regulations at different levels of our country can achieve many benign functions for this purpose, and the clean-up of laws, regulations and regulations at different levels of our country has never been interrupted. In order to form the socialist legal system with Chinese characteristics, it has played an important and positive role, but at the same time, there are some defects because of the defects of the system and the misunderstandings in practice. This paper takes the clean-up process and results of the 2008-2010 method as the research object, taking the data collected in this centralized cleaning work as the blueprint, combining the qualitative analysis and quantitative analysis writing methods, combing the theoretical and empirical aspects. It has proved that the cleaning up of this law has accomplished the established goals and played a positive role; and in the course of combing, it has been concluded that the clean-up of the law will not be eliminated with the formation of the socialist legal system with Chinese characteristics. On the contrary, it will become more and more important because of the intrinsic attribute of the negative value of written law, the legislative system of "one dollar, two levels and multiple levels" and the shift of the focus of the work of perfecting the socialist legal system with Chinese characteristics. This paper is divided into three parts. The first part analyzes the background and development of the clean-up work, organization and implementation steps, object selection and processing, The second part examines and analyzes the number, cause, category and life cycle of the laws and regulations that have been cleaned. The conclusion of the third part points out that, The clean-up of this law has realized the purpose and function of maintaining the unity of the legal system and eliminating the "bruising" of laws and regulations, and has ensured the formation of the socialist legal system with Chinese characteristics as scheduled. Under the background that the clean-up of the law has become an important part of the legislative work, The cleaning of law is indispensable, the idea of law cleaning should be changed, and the regularization mechanism of law cleaning should be established as soon as possible.
