【摘要】：南京國(guó)民政府時(shí)期的婚姻家庭立法是中國(guó)法制近代化進(jìn)程中的一個(gè)重要環(huán)節(jié)。尤其是1930年《中華民國(guó)民法·親屬編》的頒布和施行，在中國(guó)親屬法立法史上占有舉足輕重的地位。本文主要目的是通過(guò)對(duì)《中華民國(guó)民法·親屬編》的立法背景、立法淵源、立法過(guò)程以及具體制度等方面的研究，來(lái)客觀評(píng)價(jià)其性質(zhì)和地位，探究中國(guó)親屬法近代化過(guò)程中的利弊。本文主要內(nèi)容如下： 第一章是對(duì)《中華民國(guó)民法·親屬編》立法背景的分析。從清末修律到《中華民國(guó)民法·親屬編》頒行的30年間，，中國(guó)的政治、經(jīng)濟(jì)、思想文化方面發(fā)生了巨大的變化，這些變化正是親屬法近代化的動(dòng)因。 第二章是關(guān)于《中華民國(guó)民法·親屬編》的立法淵源和立法過(guò)程。這一章首先介紹了清末民初和北洋政府時(shí)期的婚姻家庭立法與南京國(guó)民政府親屬立法之間的聯(lián)系。其次對(duì)親屬編的草案起草、制定以及體例結(jié)構(gòu)上對(duì)《中華民國(guó)民法·親屬編》進(jìn)行了描述。 第三章是對(duì)《中華民國(guó)民法·親屬編》主要制度的分析。這一章從婚姻家庭法律制度中最具代表性的親屬制度、結(jié)婚制度、離婚制度和夫妻財(cái)產(chǎn)制度四個(gè)方面進(jìn)行了理論研究和分析。 第四章是關(guān)于《中華民國(guó)民法·親屬編》在移植過(guò)程中與中國(guó)國(guó)情、社會(huì)習(xí)俗的矛盾和沖突，以及法律移植在完善我國(guó)現(xiàn)行婚姻立法上的啟示和意義。
[Abstract]:The marriage and family legislation during the period of Nanjing National Government is an important link in the process of the modernization of Chinese legal system, especially the promulgation and implementation of the Civil Law of the Republic of China 路Family Editing in 1930. The main purpose of this paper is to study the legislative background, the legislative origin, the legislative process and the specific system of the Civil Law of the Republic of China. To objectively evaluate its nature and status, explore the advantages and disadvantages in the process of modernization of Chinese kinship law. The main contents of this paper are as follows:. The first chapter is the analysis of the legislative background of "the relatives of the Civil Law of the Republic of China". During the 30 years between the revision of the law and the promulgation of the Civil Law of the Republic of China, great changes have taken place in the political, economic, ideological and cultural aspects of China. These changes are the motivation of the modernization of kinship law. The second chapter is about the legislative origin and legislative process of the relatives of the Republic of China Civil Law. This chapter first introduces the marriage and family legislation between the late Qing Dynasty and the early period of the Beiyang government and the relative legislation of the Nanjing National Government. Connection. Next of all, drafting of the draft of the family part, The formulation and structure of the Civil Law of the Republic of China 路kinship Editing are described. The third chapter is the analysis of the main systems of relatives in the Civil Law of the Republic of China. This chapter analyzes the family system, the marriage system, which is the most representative of the legal system of marriage and family. The fourth chapter is about the contradiction and conflict between the "relatives of the Republic of China Civil Law" in the process of transplantation with China's national conditions, social customs, and the enlightenment and significance of law transplantation in perfecting the current marriage legislation of our country.
