【摘要】：立法者及其意圖在法律實(shí)施過(guò)程中是否發(fā)揮著以及發(fā)揮著怎樣的作用?用法者在法律生成的過(guò)程中又是否扮演著以及扮演著怎樣的角色?對(duì)這兩個(gè)問(wèn)題的回答可以從不同角度進(jìn)行。從法律的作者這一角度看,不僅僅立法者,用法者也實(shí)際上參與著法律的最終生成。因此,無(wú)論在法律實(shí)施還是法律生成的過(guò)程中,立法者與用法者實(shí)際上都是一種合作關(guān)系,也正是這種合作關(guān)系決定了他們都必得保持謙抑、克制。
[Abstract]:Do legislators and their intentions play a role in the implementation of the law? Does the user play a role in the process of law generation? From the perspective of the author of the law, not only the legislator, but also the user is actually involved in the final generation of the law. Legislators and usemakers are actually a cooperative relationship, which determines that they must be modest and restrained.
