論“禮治”的當(dāng)代意義

【摘要】:正禮治,被混同于舊禮教,在倡導(dǎo)新文化而同舊禮教決裂時(shí),一并被拋棄,差不多已經(jīng)一個(gè)世紀(jì)了。在謀求建立近代法治國家時(shí),德治、禮治,都曾被當(dāng)成和法治截然不相容的東西,而遭到全盤否定。其實(shí),這既是對(duì)德治與禮治的誤解,也是對(duì)法治的誤解。要了解禮治的當(dāng)代意義,必須正確認(rèn)識(shí)禮與禮治的根本性質(zhì),正確認(rèn)識(shí)禮治與德治、禮治與法治的內(nèi)在聯(lián)系,正確認(rèn)識(shí)禮和禮治在維系當(dāng)代各倫理性實(shí)體中不可或缺、不可替代的積極作用。
[Abstract]:It has been almost a century since it was abandoned while advocating a new culture and breaking away from the old one. In seeking to establish a modern country ruled by law, the rule of virtue and the rule of etiquette have been ruled by virtue and rule by ceremony. In fact, this is not only a misunderstanding of the rule of virtue and the rule of etiquette, but also a misunderstanding of the rule of law. To understand the contemporary significance of the rule of etiquette, we must correctly understand the fundamental nature of the ceremony and the rule of etiquette. It is necessary and irreplaceable to correctly understand the internal relationship between the rule of etiquette and the rule of virtue and the rule of law, and to correctly understand the indispensable and irreplaceable positive role of ritual and rule of etiquette in maintaining the ethical entities of the present age.
