【摘要】：在糾紛解決機制研究中,對于與命運勾連在一起的"命運型糾紛"需要給以一定的重視。此類糾紛通常因觸犯禁忌習(xí)俗、破壞隱形秩序而引發(fā),在社會生活中極易激化。命運型糾紛關(guān)涉"命運政治"和"命運正義"。命運政治是一種以命運競爭為導(dǎo)向的權(quán)力游戲,權(quán)力游戲的結(jié)果涉及正義問題。解決"命運型糾紛"需重視恢復(fù)常識性的命運正義衡平感覺和日常生活中的隱形秩序。因此,對于那些不違反國家法律、屬于公序良俗范疇的禁忌習(xí)俗不僅可以被引入司法審判之中,還可以成為地方立法的重要來源,以便為"命運型糾紛"的司法解決提供法律依據(jù)。
[Abstract]:In the research of dispute resolution mechanism, we need to pay attention to the "fate dispute" which is connected with destiny. This kind of dispute is usually caused by violating taboo custom and destroying invisible order. It is easy to intensify in social life. Destiny disputes are related to "fate politics" and "destiny justice". Destiny politics is a kind of power game guided by destiny competition. The outcome of the Game of Thrones involves justice. The resolution of "Destiny disputes" requires attention to restoring the common sense of justice of fate to the invisible order of everyday life. Therefore, for those who do not violate the law of the country, The taboo custom, which belongs to the category of public order and good custom, can not only be introduced into the judicial trial, but also become an important source of local legislation, in order to provide the legal basis for the judicial settlement of the "destiny dispute".
