【摘要】：波蘭競(jìng)爭(zhēng)法在經(jīng)濟(jì)轉(zhuǎn)軌過(guò)程中發(fā)揮了重要的作用。盡管它在形式上模仿歐盟模式,但是其制度設(shè)計(jì)和實(shí)施機(jī)制都與發(fā)達(dá)國(guó)家存在諸多差異。波蘭競(jìng)爭(zhēng)法的獨(dú)特之處在于:濫用市場(chǎng)支配地位和縱向限制競(jìng)爭(zhēng)協(xié)議的規(guī)則競(jìng)合,保護(hù)競(jìng)爭(zhēng)與保護(hù)集體消費(fèi)者利益同步進(jìn)行,以濫用市場(chǎng)支配地位和縱向限制競(jìng)爭(zhēng)協(xié)議為規(guī)制重點(diǎn),以公用企業(yè)為重點(diǎn)審查對(duì)象,在競(jìng)爭(zhēng)執(zhí)法和司法之外開(kāi)展行業(yè)調(diào)查、國(guó)家援助控制、競(jìng)爭(zhēng)宣傳和推進(jìn)等各種措施。波蘭經(jīng)驗(yàn)表明,中國(guó)應(yīng)該更加重視競(jìng)爭(zhēng)法在經(jīng)濟(jì)發(fā)展過(guò)程中的作用,以政府和國(guó)有企業(yè)的限制競(jìng)爭(zhēng)行為為重點(diǎn)規(guī)制對(duì)象,逐步提升競(jìng)爭(zhēng)執(zhí)法機(jī)關(guān)的獨(dú)立性和專業(yè)性,在競(jìng)爭(zhēng)執(zhí)法之外開(kāi)展普遍的競(jìng)爭(zhēng)推進(jìn)措施并積極發(fā)揮國(guó)務(wù)院反壟斷委員會(huì)的作用。
[Abstract]:The Polish competition law has played an important role in the process of economic transition. However, its institutional design and enforcement mechanism are different from those of developed countries. The unique features of Polish competition law are that the rules of abusing dominant market position and vertically restricting competition agreements are competing for each other. The protection of competition and the protection of the interests of collective consumers are carried out simultaneously, with the abuse of market dominance and vertical restriction of competition agreement as the focus of regulation, and the public enterprises as the focus of examination, and the conduct of industry investigations outside competition law enforcement and justice. The Polish experience shows that China should pay more attention to the role of competition law in the process of economic development, focusing on the restrictive competition behavior of the government and state-owned enterprises. Gradually enhance the independence and professionalism of competition law enforcement agencies, carry out general competition promotion measures outside competition law enforcement, and give full play to the role of the State Council Antimonopoly Commission.
