【摘要】：隨著科技的發(fā)展,人們思想觀念的逐漸改變,輔助生殖技術(shù)逐漸走入人們的視線,但緊隨的糾紛也逐漸出現(xiàn)。面對法律的空白,法律實(shí)務(wù)界、學(xué)術(shù)界都掀起了激烈的討論,尤其是對于冷凍胚胎技術(shù),因?yàn)槠鋺?yīng)用的廣泛性備受各界關(guān)注。冷凍胚胎的法律屬性問題、無主冷凍胚胎的真正享有者問題、冷凍胚胎能否被繼承等都成為目前法律學(xué)界熱衷于探討的問題,但鑒于目前我國法律對此方面未有明確規(guī)定,不同學(xué)者對此有不同看法。2014年十大最具影響力案件之一,宜興市冷凍胚胎“繼承”案將人們的視線帶入輔助生殖技術(shù)領(lǐng)域,本案主要有三個爭議焦點(diǎn)：第一、冷凍胚胎的法律屬性；第二、此案涉及的冷凍胚胎被“繼承”是否合法；第三、此案涉及的冷凍胚胎被“繼承”是否合理。針對這些爭議焦點(diǎn),通過對案情分析,得到如下結(jié)論：首先,為了更好的保護(hù)和尊重冷凍胚胎,應(yīng)將其法律屬性定義為適用于一種中間狀態(tài)的規(guī)定,而既不適用于對人的規(guī)定,也不適用于對物的規(guī)定。其次,冷凍胚胎被“繼承”具有合法性,因?yàn)樵摪杆婕暗睦鋬雠咛ゼ扔形锏膶傩?又具有獨(dú)立的人格利益,無論是從物,還是從人格利益方面來看,“繼承”都具有合法性,當(dāng)然可以作為遺產(chǎn)被其相關(guān)權(quán)利人所“繼承”。再次,冷凍胚胎被“繼承”具有合理性,該案中所涉及的四枚冷凍胚胎凝聚了四位老人失去孩子以后的希望,是“失獨(dú)”家庭的傳承期盼,是老人們的哀思寄托,四位老人當(dāng)然是胚胎人格利益的“繼承”者,由四位老人“繼承”具有合理性。最后,大膽提出冷凍胚胎收養(yǎng)制度的構(gòu)想,力求我們國家盡快完善法律,加快法制建設(shè)的進(jìn)程。
[Abstract]:With the development of science and technology and the gradual change of people's ideas and concepts, assisted reproduction technology has gradually come into people's sight, but the following disputes have also appeared. Facing the blank of law, the legal practice circle, the academic circles have all set off intense discussion. Especially with regard to frozen embryo technology, because of the wide range of its applications, there is much concern. The legal nature of frozen embryos, the problem of the real owners of frozen embryos, Whether frozen embryos can be inherited has become a hot topic in legal circles. However, since there is no clear regulation on this aspect in Chinese law at present, different scholars have different opinions on it. In 2014, one of the ten most influential cases, The case of "inheritance" of frozen embryos in Yixing City brings people's attention to the field of assisted reproductive technology. There are three main controversial points in this case: first, the legal attributes of frozen embryos; second, whether the frozen embryos involved in this case are legally inherited; Third, is it reasonable to have frozen embryos "inherited" in this case. In view of these controversies, through the analysis of the case, the following conclusions can be drawn: first, in order to better protect and respect frozen embryos, Its legal attributes should be defined as the provisions applicable to an intermediate state and not to the provisions on persons or objects. Secondly, the "inheritance" of frozen embryos is legitimate, Because the frozen embryos involved in this case have both the property of the object and the independent personality interest, both from the point of view of the object and from the point of view of the personal interest, "inheritance" has the legitimacy. Of course, it can be "inherited" as an inheritance by the relevant right holder. Thirdly, it is reasonable to have frozen embryos "inherited". The four frozen embryos involved in this case have condensed the hope of four old people after they lose their children. It is the hope of the "lost independence" family and the mourning of the elderly. Of course, the four old people are "inheritors" of the interests of the embryo personality, and it is reasonable to "inherit" by the four old people. Finally, boldly put forward the idea of freezing embryo adoption system. Strive to our country as soon as possible perfect the law, quicken the process of legal system construction.
