【摘要】：人類社會的歷史，就是一部法學家的法律思想史。正是法學家們在法學領域付出的辛勤和汗水，推動了世界法制文明的發(fā)展。隨著我國法治國家目標的確立，法學家的作用進一步凸顯。法學家在構建法治社會中的作用如此重要，而對這一問題的系統(tǒng)研究卻相當匱乏。如果對這一問題認識不清，必然影響我國的法治進程。本文嘗試著對法學家在構建法治社會中的作用問題進行探討，，希望能夠對我們的法治國家建設有所幫助。本文將從分析法學家在法治社會中的地位以及法學家的應然作用入手，繼而進一步探討法學家發(fā)揮應然作用的條件機制，最后還將探討法學家作用的異化和防范。我們認為，只有弄清了這些問題，才能更好地發(fā)揮法學家的作用，也才能更好地推動我國的法治國家建設。
[Abstract]:The history of human society is the history of legal thoughts of jurists. It is the hard work and sweat of jurists in the field of law that have promoted the development of the world legal civilization. With the establishment of the goal of our country ruled by law, The role of jurists is further highlighted. The role of jurists in building a society governed by the rule of law is so important, and systematic research on this issue is rather scarce. This paper attempts to probe into the role of jurists in the construction of a society ruled by law. This paper will analyze the position of jurists in the society of rule of law and the role of jurists, and then further explore the conditions and mechanisms for jurists to play their due role. Finally, we will discuss the alienation and prevention of jurist's role. We believe that only by making clear these problems, can we better play the role of jurists and promote the construction of our country under the rule of law.
