【摘要】:中國傳統(tǒng)法律文化是人類文明寶庫中一顆無比璀璨的明珠,它源于中國特定的政治、經(jīng)濟(jì)和文化條件,在經(jīng)過幾千年的洗禮和沉淀之后,現(xiàn)在仍然對我國社會發(fā)揮著巨大的影響。我們在極力追求西方現(xiàn)代法治的光芒的同時(shí)不能不審視中國傳統(tǒng)法律文化在現(xiàn)代法治建設(shè)中的地位和作用!扒槔矸ā币恢笔侵袊藢Ψ傻囊话愎沧R,“天理”、“人情”和“國法”之間的三位一體關(guān)系是中國傳統(tǒng)法律文化的一大特點(diǎn),這與中國傳統(tǒng)的儒家思想對中國傳統(tǒng)法律文化的影響是分不開的。在儒家思想的影響下,使得中國傳統(tǒng)法律文化具有明顯的倫理色彩。而“情”、“理”、“法”也正是這一色彩最鮮明的體現(xiàn)!扒椤薄ⅰ袄怼、“法”的位階排列順序與現(xiàn)代法治理論要求的法律至上觀念是背道而馳的,要追尋現(xiàn)代法治的光芒就必須解決這一矛盾。 文章通過對資料的分析整理研究,以歷史為經(jīng)緯,闡述了中國傳統(tǒng)法律文化的形成和發(fā)展過程,從對法家和儒家思想發(fā)展融合的過程來論述傳統(tǒng)情理法的發(fā)生和發(fā)展過程。論文從“情”、“理”、“法”的涵義及其相互之間的關(guān)系入手,,論證了情理法對現(xiàn)代法治建設(shè)存在的積極影響和消極影響,以此闡述實(shí)現(xiàn)傳統(tǒng)情理法的現(xiàn)代轉(zhuǎn)型的必要性和可能性,及其轉(zhuǎn)型途徑。 通過研究發(fā)現(xiàn),傳統(tǒng)法律文化中的情理法是中國傳統(tǒng)法律文化的一大特色,雖然“情”、“理”、“法”的位階排列順序與西方現(xiàn)代法治要求的法律至上原則相背離,但是傳統(tǒng)情理法當(dāng)中的法律“溫情”色彩,對我國現(xiàn)代法治建設(shè)并不是毫無益處的。要使傳統(tǒng)情理法發(fā)揮它的作用就必須實(shí)現(xiàn)現(xiàn)代轉(zhuǎn)型。情理法的現(xiàn)代轉(zhuǎn)型并不是單純的實(shí)現(xiàn)結(jié)構(gòu)轉(zhuǎn)型,即位階排列順序的變化,強(qiáng)調(diào)法律至上,更重要的是賦予其新的時(shí)代意義。
[Abstract]:Chinese traditional legal culture is an incomparably bright pearl in the treasure house of human civilization. It originates from China's specific political, economic and cultural conditions. After thousands of years of baptism and precipitation, At the same time, we cannot but examine the position and function of Chinese traditional legal culture in the construction of modern rule of law. It is the general consensus of the Chinese people on the law, and the trinity relationship between "natural reason", "human feeling" and "national law" is a major feature of Chinese traditional legal culture. This is inseparable from the influence of Chinese traditional Confucianism on Chinese traditional legal culture. Under the influence of Confucianism, It makes Chinese traditional legal culture have obvious ethical color. And "emotion", "reason" and "law" are the most vivid embodiment of this color. The ranking order of "emotion", "reason" and "law" and the legal supremacy required by modern theory of rule of law. Reading is contrary. In order to pursue the light of modern rule of law, we must solve this contradiction. Through the analysis and study of the materials, this paper, taking history as the warp and latitude, expounds the formation and development process of the Chinese traditional legal culture. This paper discusses the occurrence and development process of traditional rational law from the process of the development and fusion of Legalist and Confucian thoughts. This paper starts with the meaning of "emotion", "reason", "law" and the relationship between them. This paper demonstrates the positive and negative influence of the law of reason on the construction of modern rule of law, and expounds the necessity and possibility of realizing the modern transformation of the traditional law of reason and the ways of its transformation. Through the study, it is found that the rational law in the traditional legal culture is a major feature of the Chinese traditional legal culture, although the ranking order of "emotion", "reason" and "law" deviates from the legal supremacy principle required by the western modern rule of law. But the "tender" color of the law in the traditional law of reason, In order to make the traditional rational law play its role, it is necessary to realize the modern transformation. The modern transformation of the rational law is not a simple realization of the structural transformation, that is, the change of the order of order. To emphasize the supremacy of law, more importantly, to give it a new significance of the times.
