【摘要】：[目的/意義]"斯諾登事件"后,美國(guó)情報(bào)部門(mén)大規(guī)模電話(huà)元數(shù)據(jù)監(jiān)控的合憲性引致美國(guó)社會(huì)的廣泛質(zhì)疑。如何對(duì)美國(guó)情報(bào)部門(mén)大規(guī)模電話(huà)元數(shù)據(jù)監(jiān)控制度進(jìn)行改革以在國(guó)家安全維護(hù)和公民權(quán)利保障之間取得平衡遂成為無(wú)法回避的問(wèn)題。[方法/過(guò)程]通過(guò)研究美國(guó)情報(bào)部門(mén)大規(guī)模電話(huà)元數(shù)據(jù)監(jiān)控的發(fā)展、制度內(nèi)容,分析美國(guó)聯(lián)邦法院、國(guó)會(huì)對(duì)大規(guī)模電話(huà)元數(shù)據(jù)監(jiān)控合憲性問(wèn)題作出的回應(yīng)。[結(jié)果/結(jié)論]盡管《自由法案》禁止情報(bào)部門(mén)根據(jù)《愛(ài)國(guó)者法案》第215條進(jìn)行大規(guī)模電話(huà)元數(shù)據(jù)監(jiān)控,但這并不意味著情報(bào)部門(mén)大規(guī)模電話(huà)元數(shù)據(jù)監(jiān)控的終結(jié),情報(bào)部門(mén)大規(guī)模電話(huà)元數(shù)據(jù)監(jiān)控有待進(jìn)一步規(guī)制和改革。
[Abstract]:[purpose / meaning] after the Snowden incident, The constitutionality of large-scale telephone metadata surveillance by US intelligence services has led to widespread doubts in American society. How to reform the U. S. intelligence mass telephone metadata surveillance system to safeguard national security and civil rights. A balance between safeguards has become an unavoidable issue. [methods / processes] by studying the development of large-scale telephone metadata surveillance in the United States intelligence services, The content of the system, the analysis of the United States Federal Court, Congress's response to the constitutionality of large-scale telephony metadata surveillance. [results / conclusions] although the Freedom Act prohibits intelligence agencies from conducting large-scale telephone metadata surveillance under section 215 of the Patriot Act, However, this does not mean the end of large-scale telephone metadata monitoring by intelligence agencies, which needs further regulation and reform.
