【摘要】：根據(jù)黨的十八屆四中全會會議精神,依法治國、依憲治國是中國社會建設(shè)和改革的重要組成部分,是實現(xiàn)中華民族偉大復(fù)興的中國夢的前提和基礎(chǔ)。農(nóng)村社區(qū)是我國城鎮(zhèn)化、工業(yè)化過程中,應(yīng)對農(nóng)村社會問題而形成的農(nóng)村社會治理共同體,作為國家制度變遷的產(chǎn)物,農(nóng)村社區(qū)的法治化會充分發(fā)揮法治在促進、實現(xiàn)、保障社會和諧方面的重要作用,全力推進社會主義新農(nóng)村建設(shè)的全方位立體化展開�，F(xiàn)階段,我國農(nóng)村社區(qū)法治建設(shè)已經(jīng)取得了一些成就,如農(nóng)村社區(qū)法治建設(shè)基本實現(xiàn)有法可依,基層民主政治建設(shè)也在有序推進,村民自治理論逐漸成熟,多元主體有序參與農(nóng)村社區(qū)法治建設(shè)。但種種現(xiàn)實表明,進步雖有,問題依然嚴峻,不容忽視。因此,何為農(nóng)村社區(qū)法治建設(shè)?為什么要進行農(nóng)村社區(qū)法治建設(shè)?農(nóng)村社區(qū)法治建設(shè)存在哪些問題?需要如何解決?本文將深入研究農(nóng)村社區(qū)建設(shè)的基礎(chǔ)理論,結(jié)合農(nóng)村社區(qū)法治建設(shè)的實踐經(jīng)驗,在回答前述問題的同時,嘗試提出完善農(nóng)村社區(qū)法治建設(shè)的路徑,以期為農(nóng)村社區(qū)法治發(fā)展提供思路。文章重點有四部分:首先是農(nóng)村社區(qū)法治建設(shè)概述部分。從概念入手,將社區(qū)及農(nóng)村社區(qū)的基本概念和特征做了系統(tǒng)而全面的介紹,然后結(jié)合相關(guān)理論將農(nóng)村社區(qū)法治建設(shè)的實質(zhì)和內(nèi)涵做了分析,最后根據(jù)我國農(nóng)村社區(qū)法治建設(shè)的實踐,將農(nóng)村社區(qū)法治建設(shè)發(fā)展歷程做了交代。其次是農(nóng)村社區(qū)法治建設(shè)的必要性部分。本部分從發(fā)揮法治優(yōu)越性的要求、國家轉(zhuǎn)變發(fā)展戰(zhàn)略的要求、破解農(nóng)村發(fā)展難題的要求等三個方面入手,詳細回答了為什么要進行農(nóng)村社區(qū)法治建設(shè)這一問題。再次是農(nóng)村社區(qū)法治建設(shè)存在問題及成因部分。本文從農(nóng)村社區(qū)法治建設(shè)組織主體、自然人主體、法律體系、權(quán)力監(jiān)督制約機制和農(nóng)村社區(qū)法律服務(wù)制度等角度分析了現(xiàn)階段農(nóng)村社區(qū)法治建設(shè)存在的問題,并從農(nóng)村社會本身和國家法治技術(shù)層面分析了問題產(chǎn)生的原因。最后是農(nóng)村社區(qū)法治建設(shè)的完善部分。通過研究農(nóng)村社區(qū)法治建設(shè)的理論和實踐,形成以下對策:通過明確農(nóng)村社區(qū)主體法律地位、增強農(nóng)村社區(qū)居民參與度與法律意識、加強構(gòu)建具有農(nóng)村社區(qū)特色的法律體系、加強權(quán)力監(jiān)督制約體系建設(shè)、加強農(nóng)村社區(qū)法律服務(wù)制度建設(shè),完善農(nóng)村社區(qū)法治建設(shè)的體系構(gòu)建。
[Abstract]:According to the the fourth Plenary Session of the 18th CPC Central Committee meeting of party spirit, the rule of law, in accordance with the constitution is an important part of Chinese social construction and reform, is the premise and foundation of China dream of the great rejuvenation of the Chinese nation. The rural community is China's urbanization, industrialization process, the formation of rural society and deal with the problem of rural social governance community, as a product national system changes, rural community law will give full play to the rule of law, an important role in promoting, safeguard social harmony, to promote the comprehensive construction of a new socialist countryside. At present, the rural community construction of rule of law in China has made some achievements, such as the rural community construction of the rule of law the basic realization of the law, grassroots democracy is also in an orderly way, villager autonomy theory gradually mature, multi subject participation law construction in rural communities. But the reality shows that despite the progress, problems remain severe, can not be ignored. Therefore, what is the rural community construction of the rule of law? Why should the rural community construction of the rule of law? What are the problems of the rural community construction of the rule of law need? How to solve? This paper will further study the basic theory of rural community construction, combined with the practical experience of the construction of rule of law in rural community in answer to the problem, at the same time, try to put forward to improve the rural community construction of the rule of law, in order to provide ideas for rural community development of the rule of law. This paper has four parts: the first part is overview of the rural community construction of the rule of law. From the concept, the basic concepts and characteristics of community and rural community has made a systematic and comprehensive introduction then, according to the theory of the essence and connotation of rural community construction of rule of law is analyzed, according to the practice of China's rural community construction in rural areas will be the rule of law, The community construction of the rule of law development madeaccountable. Second is the necessity of rural community in the construction of rule of law. This part of the play to the superiority of the requirements of the rule of law, the state transition of development strategy, the three aspects of requirements to solve problems of rural development, a detailed answer to why the rural community construction of rule of law in this issue. Once again, the problems and causes of rural community construction of the rule of law. This article from the rural community organization construction of the rule of law subject, the subject of natural person, legal system, power mechanism and rural community legal service system and analyzes the existing rural community construction of the rule of law problem of the present stage supervision, and from the rural society itself and the national law technical analysis the causes of the problem. The last is to perfect the rural community in the construction of the rule of law. Through the study of theory and practice of rural community construction of the rule of law, form Through the following measures: a clear legal status of main body of rural community, the rural community residents participation and enhance the legal awareness, strengthen the construction of legal system of rural community characteristics, strengthen the power supervision system construction, strengthen the rural community legal service system construction, improve the construction of rural community construction of the rule of law system.
