【摘要】：為了回應(yīng)韋伯對(duì)中國傳統(tǒng)法律文化的誤讀,林端在方法論上批判了韋伯的二元對(duì)立思考方式,列舉了中國傳統(tǒng)法律文化的五種多值邏輯,即以"例"補(bǔ)"律"、"情""理""法"同為法律規(guī)范、"官方審判"與"民間調(diào)解"并行、"官方審判"和"民間調(diào)解"與"神判"互補(bǔ)、"國家法律"與"民間習(xí)慣"同為法源。但這五者其實(shí)只是"情理法融通"和"國家法與民間法統(tǒng)一"這兩種多值邏輯的反復(fù)論述。實(shí)際上,中國傳統(tǒng)法律文化還有一種更為基本的多值邏輯,即"禮法合流"。"禮法合流""情理法融通""國家法與民間法統(tǒng)一"是以儒家倫理為基礎(chǔ)的多種法源、多種糾紛解決方式并存的法律多元主義,這三種多值邏輯所對(duì)應(yīng)的分別是法律的道德基礎(chǔ)、淵源、普遍性。無論是從西方法理學(xué)層面還是從現(xiàn)代中國法律實(shí)踐層面看,三種多值邏輯現(xiàn)象都存在著頗具現(xiàn)代意涵的特征,這也是一種中國法律特殊現(xiàn)代性的體現(xiàn)。
[Abstract]:In response to Weber's misreading of Chinese traditional legal culture, Lin Duan criticizes Weber's dual opposites in methodology and enumerates five kinds of multi-valued logic of Chinese traditional legal culture. That is to say, taking "law" as an example, "emotion" "reason" "law" as legal norm, "official trial" and "folk mediation" parallel, "official trial" and "folk mediation" and "divine judgment" complement each other, "national law" and "folk custom" are the same as "folk custom". But these five people are in fact only two kinds of multi-valued logic, that is, "the fusion of reason and reason" and "unification of state law and folk law". In fact, There is also a more basic multi-valued logic in Chinese traditional legal culture, that is, "confluence of etiquette and law", "combination of propriety and law", "fusion of reason and law", "unification of state law and folk law" is a variety of legal sources based on Confucian ethics. Legal pluralism with multiple dispute resolution methods corresponds to the moral basis, origin and universality of law, both from the perspective of western jurisprudence and from the perspective of modern Chinese legal practice. The three multivalued logic phenomena all have the characteristic of modern meaning, which is also the embodiment of the special modernity of Chinese law.
