【摘要】:小產(chǎn)權(quán)房是當(dāng)前社會約定俗稱的一個概念,雖然在經(jīng)濟(jì)學(xué)或者法律上還沒有形成一個完整規(guī)范的解釋,但是卻已頻繁的出現(xiàn)在國務(wù)院辦公廳等文件中。小產(chǎn)權(quán)房產(chǎn)生于我國特殊的社會背景和特定的法律制度之下,對其是否合法專家學(xué)者和相關(guān)部門眾說紛紜。我國目前關(guān)于小產(chǎn)權(quán)房問題的立法并未考慮農(nóng)民利益,使得當(dāng)前小產(chǎn)權(quán)房糾紛日益增多。 小產(chǎn)權(quán)房糾紛不斷出現(xiàn)除了有房產(chǎn)市場規(guī)制的不足以外,主要是當(dāng)前的立法并未考慮到小產(chǎn)權(quán)房背后各方利益的博弈及平衡。在現(xiàn)有的小產(chǎn)權(quán)房糾紛判決中,雖然法院的處理合乎當(dāng)前的法律法規(guī),但是判決所依據(jù)的法律本身并未充分考慮農(nóng)民利益,因此這些判決可能存在不合理和值得斟酌的地方。 在小產(chǎn)權(quán)房的規(guī)制上,應(yīng)以處理好各方利益為出發(fā)點(diǎn),揚(yáng)利去弊,在承認(rèn)小產(chǎn)權(quán)房合法地位的前提之下,給予必要的限制。在規(guī)制中,合理平衡國家利益和集體利益,將法律效力與社會影響相統(tǒng)一,制定合理且嚴(yán)格的土地規(guī)劃和執(zhí)行計劃,通過完善我國土地流轉(zhuǎn)制度解決我國當(dāng)前小產(chǎn)權(quán)房問題。
[Abstract]:Housing with small property rights is a concept commonly known in the current social convention, although it has not yet formed a complete normative interpretation in economics or law. However, it has frequently appeared in documents such as the General Office of the State Council. Small property houses have emerged under the special social background and specific legal system of our country. There are different opinions on whether it is legal, experts, scholars and relevant departments. At present, the legislation on small property right in our country does not consider the interests of farmers, which makes the dispute of small property house increasing day by day. In addition to the deficiency of the housing market regulation, the current legislation does not take into account the game and balance of the interests of the parties behind the small-property housing. Although the court's treatment is in line with current laws and regulations, the law on which the decisions are based does not by itself take full account of the interests of the farmers, and these decisions may therefore be unreasonable and worth considering. In the regulation of small property houses, we should deal with the interests of all parties as the starting point, promote advantages and disadvantages, and give necessary restrictions on the legal status of small property houses. In the regulation, we should strike a reasonable balance between national interests and collective interests. This paper unifies the legal effect with the social influence, formulates the reasonable and strict land planning and execution plan, and solves the problem of the small property right house in our country by perfecting the land circulation system in our country.
