【摘要】：縣域在國(guó)家法治建設(shè)中處于極為重要的地位,既是法治改革民眾參與的重要試驗(yàn)場(chǎng),又是法治社會(huì)效果的檢驗(yàn)場(chǎng),能夠達(dá)成對(duì)改革風(fēng)險(xiǎn)的有效控制。作為法治建設(shè)的試驗(yàn)場(chǎng),縣域法治建設(shè)應(yīng)該遵循觀念—制度—行為—效果的路徑,通過(guò)民主政治的基層實(shí)踐,塑造和強(qiáng)化領(lǐng)導(dǎo)干部、執(zhí)法人員和民眾的法治觀念;以決策機(jī)制、執(zhí)法權(quán)、司法權(quán)運(yùn)行法治化為制度導(dǎo)向,建構(gòu)符合法治原則與精神的決策制度、領(lǐng)導(dǎo)干部選拔任用制度、執(zhí)法制度、司法制度和民眾參與制度、權(quán)利保障與救濟(jì)制度等,筑牢縣域法治的制度基礎(chǔ);同時(shí),也要對(duì)縣域法治試驗(yàn)的效果進(jìn)行評(píng)估,通過(guò)評(píng)估量化法治實(shí)踐并引導(dǎo)縣域法治的科學(xué)構(gòu)建,應(yīng)注重評(píng)估方法選擇和指標(biāo)設(shè)定的科學(xué)性、合理性,強(qiáng)調(diào)評(píng)估過(guò)程的公開(kāi)性、評(píng)估結(jié)果的反饋性,推動(dòng)縣域法治試驗(yàn)的科學(xué)理性發(fā)展。
[Abstract]:County is in an extremely important position in the construction of national rule of law. It is not only an important test ground for the participation of the people in the reform of the rule of law, but also a testing ground for the social effect of the rule of law, which can achieve effective control of the reform risks and serve as the test ground for the construction of the rule of law. The construction of county rule of law should follow the path of concept, system, behavior and effect, mold and strengthen the concept of ruling by law of leading cadres, law enforcement personnel and the public through the practice of democratic politics at the grass-roots level, and take the decision-making mechanism, the right of enforcement of law, the right to enforce the law, The operation of judicial power is governed by law for the guidance of the system, and the decision-making system, which conforms to the principle and spirit of the rule of law, the system of selecting and appointing leading cadres, the system of law enforcement, the system of judicial system and the system of popular participation, the system of protection and relief of rights, etc. At the same time, it is necessary to evaluate the effect of the county rule of law experiment. By evaluating the practice of the rule of law and guiding the scientific construction of the county rule of law, we should pay attention to the scientific selection of evaluation methods and the setting of indicators. The rationality emphasizes the openness of the evaluation process and the feedback of the evaluation results, which promotes the scientific and rational development of the county rule of law experiment.
