蜀漢民族法制思想與實踐研究

【摘要】:三國時期,魏、蜀、吳鼎足而立,互相爭戰(zhàn)。采取恰當?shù)拿褡逭?處理好與境內(nèi)外各民族之間的關(guān)系,增加人口,發(fā)展生產(chǎn),對于政權(quán)的鞏固與發(fā)展都具有重要的意義。蜀漢(221—263年)共歷二帝,僅存四十二年,以人口、兵力、經(jīng)濟、地理面積等來看,蜀漢無疑是三國之中最弱的一個,然而其民族治理卻有它成功的地方。蜀漢民族法制以信義為指導思想,突破了中國古代認為少數(shù)民族“貪而無信”、“貪利忘義”、“獨可以威服”等流行觀念,這是蜀漢民族法制實踐成功的主要原因。緒論交代了選題緣由及價值,對“信義”和“民族法制”兩個基本概念做了界定,對以往相關(guān)研究做了回顧與述評,說明了本文的主要研究方法以及創(chuàng)新點。第一章通過對三國時期思想與政治背景以及民族觀的探討,分析了蜀漢民族法制特別是其民族刑事與軍事法制產(chǎn)生、形成的時代背景。對諸葛亮《隆中對》提出的“西和諸戎,南撫夷越”背景以及實現(xiàn)進行了論述。認為諸葛亮惜赦的原因之一在于其不拘泥于“以夏變夷”。第二章主要從蜀漢南征之后郡縣設立及其民族地區(qū)官吏任用兩個方面探討了蜀漢民族行政法制。蜀漢分立郡縣的首要目的與作用在于分割南中勢力以加強對于南中的控制,但也有助于增進南中各民族對于蜀漢政權(quán)的認同。蜀漢文武并舉等人才選用的特點,對于民族地區(qū)的穩(wěn)定與發(fā)展起到了重要作用。蜀漢在平定南中后來的叛亂時同樣奉行了“南撫夷越”的方針。第三章從“崇尚節(jié)儉,抑制奢侈”、鹽鐵官營、興利除害等幾個方面對蜀漢民族經(jīng)濟法制進行了研究。蜀漢尚儉戒奢既是對劉璋“民殷國富而不知存恤”的反思,也是對蜀地時俗奢侈的變革,有利于減少民族地區(qū)官民矛盾,促進民夷融合。蜀漢為適應軍事與經(jīng)濟的需要,實行鹽鐵官營的政策,不僅供應軍資,也便于民族地區(qū)鹽鐵業(yè)的進步和鐵器農(nóng)具的推廣。通過重視農(nóng)桑以及橋梁道路建設,蜀漢促進了民族地區(qū)的經(jīng)濟開發(fā),加強了對民族地區(qū)的控制與聯(lián)系。第四章通過對莊巤王滇與諸葛亮崇拜的比較分析,提出“共同的祖源”并不足以將原本認為不同的族群凝聚為一個共同體,其背后其實是文化的因素在起著重要的作用。蜀漢民族法制實踐之所以能夠獲得成功,離不開其以信義為指導思想,經(jīng)由后世對劉備、諸葛亮的評價,我們可以將信義思想的主要原則概括為公平、仁愛與包容。結(jié)語部分指出中國古代流行觀念認為少數(shù)民族無信義可言,這就導致片面強調(diào)經(jīng)濟利益與武力威懾,對于信念、態(tài)度和價值觀則不夠重視。蜀漢民族法制思想與實踐在此方面對我們?nèi)杂兄匾慕梃b與啟示意義。
[Abstract]:During the period of the three Kingdoms, Wei, Shu and Wu stood on their feet and fought against each other. Appropriate national policies were adopted to handle the relations between the ethnic groups inside and outside the country, to increase the population and to develop production. It is of great significance to the consolidation and development of the regime. Shuhan (221-263) survived only 42 years. In terms of population, military strength, economy, geographical area and so on, Shu Han was undoubtedly the weakest of the three Kingdoms. However, its national governance has its success. The legal system of the Shu Han nationality, guided by faithfulness, broke through the popular ideas in ancient China that the minority nationalities were "greedy and untrustworthy", "greedy for profit and unrighteous", and "independent and powerful," and so on. This is the main reason for the successful practice of Shuhan nationality legal system. The introduction explains the reason and value of selecting the topic, defines the two basic concepts of "faithfulness" and "national legal system", and reviews and comments on the previous relevant studies. The first chapter analyzes the legal system of Shu Han nationality, especially the emergence of its national criminal and military law, through the discussion of the ideological and political background of the three Kingdoms period, as well as the national view of nationality.
