【摘要】：本文旨在從法律規(guī)制的角度,對(duì)新時(shí)期中國(guó)對(duì)外援助法律體系的構(gòu)建問(wèn)題進(jìn)行研究。本文主要梳理了國(guó)際援助法律規(guī)制的發(fā)展歷史,對(duì)中國(guó)對(duì)外援助法律框架的發(fā)展現(xiàn)狀和存在問(wèn)題進(jìn)行了客觀評(píng)價(jià),就構(gòu)建中國(guó)對(duì)外援助法律體系進(jìn)行展望并提出有關(guān)建議。論文共分為六章。第一章引言介紹了論文選題的背景和意義、國(guó)內(nèi)外在對(duì)外援助法律規(guī)制方面的文獻(xiàn)基礎(chǔ)和研究成果、擬解決的問(wèn)題、研究方法、難點(diǎn)和不足。第二章討論了對(duì)外援助和法律體系兩個(gè)概念,梳理了對(duì)外援助法律規(guī)制史。第三章概括介紹了英、美兩個(gè)西方主要援助國(guó)對(duì)外援助法律體系的基本情況。第四章、第五章是本文的重點(diǎn)部分,分別客觀評(píng)價(jià)了中國(guó)對(duì)外援助法律框架的發(fā)展現(xiàn)狀和特點(diǎn)以及其中存在的不足,分析了對(duì)外援助法律體系建設(shè)的作用,并從頂層設(shè)計(jì)、縱向完善、橫向發(fā)展三個(gè)角度分析構(gòu)建中國(guó)對(duì)外援助法律體系的基本路徑。第六章是結(jié)論部分,提出解決對(duì)外援助法缺位問(wèn)題,是加快構(gòu)建中國(guó)特色對(duì)外援助法律體系的核心。
[Abstract]:The purpose of this paper is to study the construction of China's foreign aid legal system in the new era from the perspective of legal regulation. The current situation and existing problems of China's foreign aid legal framework have been objectively evaluated. The thesis is divided into six chapters. The first chapter introduces the background and significance of the topic, the literature basis and research results of the legal regulation of foreign aid at home and abroad. The second chapter discusses two concepts of foreign aid and legal system, combing the history of legal regulation of foreign aid. The basic situation of the foreign aid legal system of the two major western aid countries in the United States. Chapter 4th, Chapter 5th is the key part of this paper, which objectively evaluates the current situation and characteristics of the legal framework of China's foreign aid and its shortcomings. This paper analyzes the function of the construction of foreign aid legal system, and analyzes the basic path of constructing China's foreign aid legal system from three angles of top-level design, longitudinal perfection and horizontal development. Chapter 6th is the conclusion part. It is the core of speeding up the construction of the legal system of foreign aid with Chinese characteristics to solve the vacancy of foreign aid law.
