【摘要】：正當程序原則是美國憲法確定的一項政府行為原則與司法審查原則,其涵義在法律發(fā)展過程中經(jīng)歷了很大的變化。正當程序原初僅有程序性涵義,后來經(jīng)過司法判例中法官的解讀,又具有了實體性涵義。20世紀70年代以來,由于學生在公立學校接受教育逐漸被視為了一項受憲法保護的財產(chǎn)權利,因此,公立學校對學生的停學處分開始適用憲法上的正當程序原則。Goss案及其所確立的學生短期停學及開除處分的程序性標準與實體性標準,有效地平衡了公立學校管理學生的權力與學生的受教育權利,可以為公立學校正確行使停學處分提供參照。
[Abstract]:The principle of due process is a principle of government behavior and judicial review established by the Constitution of the United States, the meaning of which has undergone great changes in the course of the development of law. At the beginning of due process, there is only a procedural meaning. Since 70s of the 20th century, students' education in public schools has gradually been regarded as a property right protected by the Constitution. The constitutional principle of due process. Goss and the procedural and substantive standards established for the suspension and dismissal of students in public schools have been applied to the suspension of students in public schools. It effectively balances the rights of public schools to manage students and students to receive education, which can provide a reference for public schools to correctly exercise suspension.
