【摘要】：五千年華夏文明,鑄就了中華法系恢弘燦爛的畫卷,在封建法制的歷史長河中,恤刑作為一項影響中華法系深遠的法律制度而大放異彩。恤刑的產(chǎn)生及發(fā)展在我國有著深刻的時代背景因素,恤刑發(fā)端于西周,發(fā)展于漢唐時期,之后歷代封建王朝將其逐步完善化,.成為我國古代法制中的一項重要制度。恤刑制度的發(fā)展歷程是一個不斷儒家化的過程,將儒家的“仁學”思想融入法律制度之中。清王朝是中國古代最后一個封建王朝,其法律的完善達到了封建社會的頂峰,而在恤刑制度上清代吸收了歷朝歷代有關(guān)恤刑制度的法律規(guī)定,建立起來一整套從立法、司法、執(zhí)法三個方面配合的恤刑制度體系,都體現(xiàn)了統(tǒng)治者“以人為本”的人道主義之懷和對天下百姓的“寬仁”“憫恤”之心。本文旨在通過對清代恤刑制度的分析研究,展現(xiàn)其本身所包含的理論基礎、主要內(nèi)容、歷史意義以及如何來評價這一刑事法律制度,所謂“鑒古明今”,在我們當代推進法治現(xiàn)代化的進程中,應當吸收清代恤刑的人本思想,以達健全我國法律體系、推進現(xiàn)代法治建設之目標。
[Abstract]:Five thousand years of Chinese civilization, cast the Chinese law system magnificent magnificent scroll, in the feudal legal system in the long history, The emergence and development of compassionate punishment has a profound background factor in our country. It originated in the Western Zhou Dynasty and developed in the Han and Tang dynasties. Later, the feudal dynasties gradually perfected it. It became an important system in the ancient legal system of our country. The development of the system of compassionate punishment was a process of continuous Confucianization. The Qing Dynasty was the last feudal dynasty in ancient China, and the perfection of its law reached the peak of feudal society. In the system of compassionate punishment, the Qing Dynasty absorbed the legal provisions of the past dynasties on the system of compassionate punishment, and established a comprehensive system of compassionate punishment, which was coordinated from three aspects: legislation, judicature, and law enforcement. Both reflect the humanitarianism of the ruler "people-oriented" and the "benevolence" and "compassion" of the people in the world. Through the analysis and study of the pension punishment system in the Qing Dynasty, this article aims to show the theoretical basis and main contents contained in it. Historical significance and how to evaluate this criminal legal system, the so-called "Jian Gu Ming Today", in our contemporary process of promoting the modernization of the rule of law, we should absorb the humanistic thinking of the Qing Dynasty, in order to improve the legal system of our country. The goal of promoting the construction of modern rule of law.
