【摘要】：地理標志保護作為二十一世紀中國法律研究熱點之一,已經(jīng)不單單是一個法律和經(jīng)濟問題,更是一個政治問題。地理標志法律研究雖然在我國開展得相對較晚,但經(jīng)過相關(guān)各界地不斷努力探索,特別是近十多年來社會對地理標志價值認識地不斷提高以及各項相關(guān)立法的不斷完善,地理標志法律研究已經(jīng)在我國取得了相當?shù)某晒?但是我國地理標志研究主要集中在歐洲等地理標志制度較為發(fā)達的地區(qū)。而日本作為我們的近鄰,文化上同源,法律體系上也有千絲萬縷的聯(lián)系,因此,對日本地理標志保護制度展開研究也是十分必要的。 本文正是基于上述考慮,從四個方面對其展開了研究：首先,通過對比前后TRIPS時代日本地理標志的保護來對其地理標志法律制度沿革做了一個大致介紹；其次,對日本現(xiàn)行的地理標志保護制度從國際和國內(nèi)體系兩個方面做了較為詳細的介紹,特別是對日本地理標志法律保護體系當中的國內(nèi)積極保護體系作了較為全面的介紹；再次,從戰(zhàn)略層面、立法層面和執(zhí)法層面詳細介紹了日本地理標志法律保護體系的特點；最后,介紹了我國地理標志法律保護模式及存在的主要問題,并結(jié)合日本地理保護制度中優(yōu)秀的因素,從戰(zhàn)略層面、一元體系方面、行政管理及私力救濟方面、加強農(nóng)業(yè)協(xié)會建設(shè)方面及加強相關(guān)人才培養(yǎng)方面對如何完善我國地理標志保護制度給出了一定的司法建議。
[Abstract]:In 21th century, as one of the hotspots of Chinese legal research, the protection of geographical indications is not only a legal and economic issue, but also a political issue. However, through the efforts of all circles concerned, especially in the past ten years, the value of geographical indications has been continuously improved and the relevant legislation has been continuously improved, the legal study of geographical indications has achieved considerable results in China. However, the study of geographical indications in our country is mainly concentrated in the areas where the geographical indication system is relatively developed, such as Europe. As our close neighbor, Japan is culturally homologous, and the legal system is inextricably linked, so, It is also necessary to study the protection system of geographical indications in Japan. Based on the above considerations, this paper studies it from four aspects: first, by comparing the protection of Japanese geographical indications before and after the TRIPS era to make a general introduction to the evolution of the legal system of geographical indications; secondly, This paper introduces in detail the current protection system of geographical indications in Japan from the international and domestic aspects, especially the domestic active protection system of the legal protection system of geographical indications in Japan. Thirdly, From the strategic level, legislative level and law enforcement level, this paper introduces the characteristics of Japan's geographical indication legal protection system in detail, and finally, introduces the legal protection mode and main problems of China's geographical indications. And combining with the outstanding factors in Japan's geographical protection system, from the strategic level, monolithic system, administration and private relief, In the aspect of strengthening the construction of agricultural association and strengthening the cultivation of related talents, some judicial suggestions are given on how to perfect the protection system of geographical indications in China.
