【摘要】：近幾年來(lái),見(jiàn)危不助的現(xiàn)象時(shí)有發(fā)生,其結(jié)果往往令人義憤填膺,卻又不禁發(fā)出“不是沒(méi)有愛(ài)心,是扶不起”的感嘆�？梢哉f(shuō),傳統(tǒng)道德觀在現(xiàn)代法治建設(shè)中正面臨著新的挑戰(zhàn)：一方面,現(xiàn)代權(quán)利意識(shí)、責(zé)任意識(shí)強(qiáng)有力地興起,導(dǎo)致了人們對(duì)見(jiàn)危不助這一社會(huì)現(xiàn)象產(chǎn)生多元化理解；另一方面,對(duì)于如何規(guī)制這一有悖于道德和情理的社會(huì)現(xiàn)象,人們正嘗試著進(jìn)行深層次的理性思考和多角度的理論分析,以求得到一個(gè)恰如其分的解釋。 筆者認(rèn)為,如果對(duì)見(jiàn)危不助者追究其法律責(zé)任,是明顯缺乏法律依據(jù)的。然而,見(jiàn)危不助作為一種大量存在的社會(huì)現(xiàn)象,經(jīng)由現(xiàn)代媒體迅速傳播,必然會(huì)在客觀上造成巨大的負(fù)而影響,并且不斷超越社會(huì)的道德底線而呈現(xiàn)出愈演愈烈之勢(shì)。這就給我國(guó)當(dāng)下的社會(huì)主義建設(shè),和諧社會(huì)的構(gòu)建以及社會(huì)主義精神文明建設(shè)都帶來(lái)了非常嚴(yán)峻的挑戰(zhàn)。但問(wèn)題在于,見(jiàn)危不助現(xiàn)象本身的尷尬就是它并非由法律調(diào)整,而屬于道德規(guī)范的范疇,所以,社會(huì)各界在紛紛對(duì)此加以抨擊的同時(shí)卻找不到實(shí)際的解決辦法,都顯得束手無(wú)策。有學(xué)者主張將見(jiàn)危不助犯罪化,也有人反對(duì),各種觀點(diǎn)層出不窮、各執(zhí)一詞,難以達(dá)成共識(shí)。其實(shí),我們應(yīng)當(dāng)從社會(huì)科學(xué)的全方位、多角度進(jìn)行反思,從文化、政治、經(jīng)濟(jì)等領(lǐng)域中獲取力量來(lái)解決當(dāng)下這一現(xiàn)實(shí)的社會(huì)問(wèn)題。因此,要正確走出見(jiàn)危不助這一困境,首先要找出導(dǎo)致該現(xiàn)象產(chǎn)生的根本原因,運(yùn)用文化和制度層面的理念去分析和研究,并從中吸取寶貴經(jīng)驗(yàn)來(lái)化解民眾對(duì)見(jiàn)危不助現(xiàn)象的冷漠,以推進(jìn)這一社會(huì)頑疾的消除,從而促進(jìn)社會(huì)和諧。
[Abstract]:In recent years, the phenomenon of seeing danger and failing to help has occurred from time to time. The results are often filled with indignation, but they can't help exclaiming that "it is not without love, it is unable to support it." it can be said that, The traditional morality is facing new challenges in the construction of modern rule of law: on the one hand, the consciousness of modern rights and responsibility rises forcefully, which leads people to have a pluralistic understanding of the social phenomenon of seeing danger or not helping; on the other hand, As to how to regulate this social phenomenon which is contrary to morality and reason people are trying to carry out deep rational thinking and multi-angle theoretical analysis in order to obtain a proper explanation. The author believes that it is obviously lack of legal basis to investigate the legal liability of those who do not help. However, as a large number of social phenomena, it is spread rapidly through the modern media. It will inevitably cause a huge negative impact objectively, and continue to exceed the moral bottom line of society and present a growing trend. This will give our country the current socialist construction. The construction of a harmonious society and the construction of a socialist spiritual civilization have brought very serious challenges. But the problem is that the embarrassment of seeing danger or not helping itself is that it is not regulated by law, but belongs to the category of moral norms, so, While all sectors of society have criticized this one after another, they have failed to find a practical solution. There are scholars who advocate not helping to criminalize the situation, while others oppose it, and various views emerge in endlessly, each insisting on its own. It is difficult to reach a consensus. In fact, we should reflect on the social science from all aspects, from many angles, from the cultural, political, economic and other fields to solve this realistic social problem. In order to get out of the dilemma of seeing danger correctly and not helping, we must first find out the root cause of this phenomenon, analyze and study it with the concept of culture and system, and draw valuable experience from it to defuse the indifference of the people to the phenomenon of seeing danger or not helping. In order to promote the elimination of this social ills, thereby promoting social harmony.
