【摘要】：德沃金的權(quán)利理論是一種個(gè)人主義權(quán)利觀,"詮釋"與"人性尊嚴(yán)"是其中的兩個(gè)關(guān)鍵詞。"詮釋"確定了權(quán)利的表現(xiàn)形式,權(quán)利表現(xiàn)為一種個(gè)體性的詮釋實(shí)踐;"人性尊嚴(yán)"則賦予權(quán)利以價(jià)值,權(quán)利的價(jià)值在于它承認(rèn)與尊重每一個(gè)人的內(nèi)在價(jià)值與責(zé)任�！墩J(rèn)真對(duì)待權(quán)利》、《法律帝國(guó)》與《刺猬正義》這三部著作代表了德沃金權(quán)利理論的三個(gè)發(fā)展階段,權(quán)利的個(gè)人主義觀念在此過程中得以形成與完善。該權(quán)利觀雖然極為精致且具有說服力,但并非理解權(quán)利的唯一可能路徑。
[Abstract]:Dworkin's theory of rights is an individualistic view of rights, in which "interpretation" and "human dignity" are two key words. Right is expressed as a kind of individual interpretation practice, "human dignity" gives value to right, The value of right lies in its recognition of and respect for everyone's intrinsic values and responsibilities. "take Rights seriously", "the legal Empire" and "Justice of the hedgehog" represent the three stages of Dworkin's theory of rights. The individualism of right is formed and perfected in this process. Although it is very delicate and persuasive, it is not the only possible way to understand the right.
