【摘要】：法治與改革的沖突并非當(dāng)前二者關(guān)系的主要方面。短期講,二者均在全面建成小康社會中扮演著至關(guān)重要的角色;長期看,法治是改革的目標(biāo),改革是法治的動力。在此前提下,當(dāng)前法治與改革間的張力直接反映在如何協(xié)調(diào)法律本身的穩(wěn)定性與變動上。在全面深化改革進(jìn)程中,可以選擇運(yùn)用授權(quán)規(guī)則規(guī)范與引導(dǎo)改革的地方試驗(yàn),將其納入法治軌道,從而協(xié)調(diào)法治與改革的關(guān)系。
[Abstract]:The conflict between the rule of law and reform is not the main aspect of the current relationship between the two. In the short run, both of them play a vital role in building a well-off society in an all-round way; in the long run, the rule of law is the goal of the reform. Reform is the driving force of the rule of law. Under this premise, the tension between the rule of law and the reform is directly reflected in how to coordinate the stability and change of the law itself. We can choose to regulate and guide the reform by using the authorization rules and bring it into the track of the rule of law so as to coordinate the relationship between the rule of law and the reform.
