【摘要】：研究源自《大清現(xiàn)行刑律》的"現(xiàn)行律民事有效部分"何以能夠作為民初民事審判的主要依據(jù)。分析認(rèn)為,《大清現(xiàn)行刑律》的內(nèi)容、結(jié)構(gòu)和在清末的實(shí)施是重要鋪墊,民初政治和法制環(huán)境造成的民事審判法源的缺失是客觀使然,深層原因是當(dāng)時(shí)中國社會(huì)的經(jīng)濟(jì)、社會(huì)基礎(chǔ)沒有根本改變;經(jīng)過立法與司法"合力作用"下的"現(xiàn)行律民事有效部分",它的適用促使完整意義上的民法近代化進(jìn)一步推進(jìn),雖為過渡之用,卻構(gòu)成了民法近代化歷程中古今中外民法交匯的"樞紐"。
[Abstract]:In this paper, the author studies how the effective part of the current criminal law of Qing Dynasty can be regarded as the main basis of civil trial in the early Republic of China. It is concluded that the content, structure and implementation of the current criminal law in the Qing Dynasty are the important paves for laying the groundwork for the civil trial in the late Qing Dynasty. The lack of the legal source of civil trial caused by the political and legal environment in the early Republic of China was caused by objectivity. The deep reason was that the economic and social foundation of Chinese society had not changed fundamentally at that time. Through the "effective part of civil law in force" under the combination of legislation and judicature, its application promotes the modernization of civil law in a complete sense, though it is used for the transition. However, it constitutes the "hub" of civil law in the course of modernization of civil law at all times and all over the world.
