【摘要】：縱觀新中國前30年和改革開放后30年整體發(fā)展和現(xiàn)實(shí)狀況,我國法治建設(shè)走出一條艱難曲折、成績顯著而又獨(dú)具特色的發(fā)展道路。在完成法治建設(shè)撥亂反正的基礎(chǔ)上,逐步確立了“依法治國,建設(shè)社會(huì)主義法治國家”的戰(zhàn)略目標(biāo),扎實(shí)推進(jìn)法治建設(shè)的現(xiàn)代化、制度化進(jìn)程�？茖W(xué)發(fā)展觀的提出,為社會(huì)主義法治建設(shè)提供了一個(gè)重要的理論武器。它瞄準(zhǔn)了中國特色法治建設(shè)的價(jià)值定位,喚醒了中國特色法治建設(shè)的創(chuàng)新基因,為中國特色法治建設(shè)提供了一種全新的發(fā)展視角。面對(duì)新世紀(jì),開展科學(xué)發(fā)展觀視閾下中國特色法治建設(shè)研究具有重大的理論價(jià)值和深遠(yuǎn)的現(xiàn)實(shí)意義。在發(fā)展方式上,“以人為本”的新法治理念,全面改造和提升傳統(tǒng)的“以法為本”舊觀念,實(shí)現(xiàn)了社會(huì)主義法治發(fā)展方式的深層次轉(zhuǎn)變。在理論指導(dǎo)上,科學(xué)發(fā)展觀是馬克思主義中國化的最新理論成果,全方位指導(dǎo)著中國特色社會(huì)主義法治建設(shè)。在現(xiàn)實(shí)作用上,深入貫徹落實(shí)科學(xué)發(fā)展觀,加快推進(jìn)依法治國基本方略,是中國特色社會(huì)主義法治建設(shè)的迫切要求。 本文的研究內(nèi)容分為四大部分。第一部分(第1章)是緒論,主要介紹選題的目的和意義、國內(nèi)外研究現(xiàn)狀、研究內(nèi)容以及研究方法;第二部分(第2章)是對(duì)新中國成立以來、特別是改革開放以來中國特色法治建設(shè)的發(fā)展脈絡(luò)進(jìn)行系統(tǒng)的梳理,進(jìn)而總結(jié)法治建設(shè)所取得的豐碩成果以及法治建設(shè)中存在的一些問題。第三部分(第3章)闡述了科學(xué)發(fā)展觀視閾下的中國特色法治建設(shè),通過價(jià)值創(chuàng)新展現(xiàn)法治建設(shè)“以人為本”、步驟創(chuàng)新體現(xiàn)法治建設(shè)“全面協(xié)調(diào)可持續(xù)發(fā)展”、方法創(chuàng)新彰顯法治建設(shè)“統(tǒng)籌兼顧”這三個(gè)方面闡述科學(xué)發(fā)展觀對(duì)中國特色法治建設(shè)的創(chuàng)新基點(diǎn)。第四部分(第4章)闡述了科學(xué)發(fā)展觀指導(dǎo)中國特色法治建設(shè)的現(xiàn)實(shí)意義,即是增強(qiáng)黨的執(zhí)政能力和執(zhí)政水平的迫切需要,是建設(shè)社會(huì)主義法治國家的必然要求,是構(gòu)建和諧法治的內(nèi)在要求,是人民當(dāng)家作主的重要體現(xiàn)。第五部分(第5章)是結(jié)論和討論,是對(duì)全文的總結(jié)和理論概括。
[Abstract]:Throughout the first 30 years of New China and 30 years after the reform and opening up of the overall development and reality, China's rule of law construction out of a difficult and tortuous, remarkable achievements and unique development path. The strategic goal of "running the country according to law and building a socialist country ruled by law" has been gradually established, and the modernization and institutionalization of the construction of the rule of law have been firmly promoted. It aims at the value orientation of the construction of the rule of law with Chinese characteristics and awakens the innovative gene of the construction of the rule of law with Chinese characteristics. For the construction of the rule of law with Chinese characteristics to provide a new perspective of development. Facing the new century, It is of great theoretical value and far-reaching practical significance to carry out the research on the construction of the rule of law with Chinese characteristics from the perspective of the scientific development view. In the way of development, the new concept of "people-oriented" rule of law, the comprehensive reform and promotion of the traditional "law-based" old concept, Under the guidance of theory, the scientific development view is the latest theoretical achievement of Marxism in China, which guides the construction of socialist rule of law with Chinese characteristics in all directions. It is an urgent requirement for the construction of the rule of law of socialism with Chinese characteristics to carry out the concept of scientific development and accelerate the basic strategy of governing the country according to law. The first part (chapter 1) is the introduction, which mainly introduces the purpose and significance of the topic, the current research situation at home and abroad, the research content and the research methods; The second part (Chapter 2) is a systematic analysis of the development of the rule of law construction with Chinese characteristics since the founding of New China, especially since the reform and opening up. The third part (chapter 3) expounds the construction of the rule of law with Chinese characteristics from the perspective of the scientific development concept, and then summarizes the fruitful achievements made in the construction of the rule of law and some problems existing in the construction of the rule of law. Through the value innovation to show the "people-oriented" of the rule of law construction, step innovation reflects the rule of law construction "overall coordinated and sustainable development", the method of innovation to highlight the rule of law construction "overall consideration" of the three aspects of the scientific concept of development to China. Part 4th (Chapter 4) expounds the practical significance of the scientific concept of development to guide the construction of the rule of law with Chinese characteristics. That is, it is the urgent need to strengthen the ruling ability and the ruling level of the Party, the inevitable requirement of building a socialist country ruled by law, and the inherent requirement of building a harmonious rule of law. Part 5th (Chapter 5) is the conclusion and discussion, the summary and theoretical summary of the full text.
