【摘要】：在社會主義核心價值觀中,將"法治"作為社會層面核心價值取向具有正當性,社會之維的法治理念對當前我國的法治建設意義重大。"法治"作為社會層面的核心價值,將對公民的法律意識起到重要的引領作用,有利于在全社會形成法治共識,進而為推進法治建設提供良好的思想基礎和文化氛圍。探討社會主義核心價值觀對我國法治建設的導向和引領功能,必須闡明核心價值觀引領法治建設的方式,并探索社會主義核心價值觀作為價值宗旨如何以規(guī)范化的方式進入法律判斷,進而影響法治實踐。將"法治"作為社會層面的核心價值,充分體現(xiàn)了當前我國的法治建設緊跟時代形勢,反映了社會需求,切實維護了社會公眾的權利和自由,促進了社會福祉。這也無疑有利于提升我國法治建設的實質正當性,凝聚法治共識,充分調動社會內在力量,促進法治的發(fā)展。
[Abstract]:In the socialist core values, it is legitimate to regard "rule of law" as the core value orientation of the social level, and the concept of the rule of law of the social dimension is of great significance to the construction of the rule of law in our country at present. "the rule of law" is the core value of the social level. It will play an important leading role in the legal consciousness of citizens and help to form a consensus on the rule of law in the whole society. So as to provide a good ideological basis and cultural atmosphere for promoting the construction of the rule of law, it is necessary to clarify the way in which the core values lead the construction of the rule of law in order to explore the guiding and leading functions of the socialist core values in the construction of the rule of law in China. It also explores how socialist core values, as value purposes, enter the legal judgment in a standardized manner, and then influence the practice of the rule of law, and regard the "rule of law" as the core value of the social level. The construction of the rule of law in our country fully reflects the current situation of the times, reflects the needs of the society, effectively preserves the rights and freedoms of the public, and promotes the welfare of the society. This is undoubtedly conducive to the promotion of the legitimacy of the construction of the rule of law in our country. Condense the consensus on the rule of law, fully mobilize the inherent strength of society, and promote the development of the rule of law.
