從“言說”到“行動(dòng)”--法學(xué)教育模式變遷的知識(shí)論考察

【摘要】:長期以來中國法學(xué)教育以概念法學(xué)思路下的"言說者"話語所宰制,遮蔽了法學(xué)作為古老學(xué)問的"行動(dòng)者"知識(shí)傳統(tǒng)和實(shí)踐技藝,遠(yuǎn)離了其作為一門獨(dú)特學(xué)問的性格和生成基礎(chǔ)。對(duì)法學(xué)的知識(shí)基礎(chǔ)分析一方面證成了法學(xué)教育中"行動(dòng)者"實(shí)踐先行的哲學(xué)命題,另一方面也揭示:只有在知識(shí)論上處理好法學(xué)作為"實(shí)踐技藝"的獨(dú)特性,才能還原法學(xué)作為"實(shí)踐知識(shí)"的古老學(xué)問和知識(shí)傳統(tǒng),實(shí)現(xiàn)現(xiàn)代法學(xué)教育從"言說者"到"行動(dòng)者"的模式變遷,適應(yīng)社會(huì)主義法治國家建設(shè)的需要。
[Abstract]:For a long time, Chinese legal education has been dominated by the discourse of "speaker" under the idea of conceptual jurisprudence, which has obscured the knowledge tradition and practical skills of law as an "actor" of ancient learning. The analysis of the knowledge base of law on the one hand proves to be the philosophical proposition of "actor" practice first in law education. On the other hand, it also reveals that only by properly handling the uniqueness of law as "practical skill" in the theory of knowledge, can the ancient knowledge and tradition of law as "practical knowledge" be restored. The mode of modern legal education from "speaker" to "actor" can meet the needs of the construction of socialist country ruled by law.
