從“言說”到“行動”--法學教育模式變遷的知識論考察

【摘要】:長期以來中國法學教育以概念法學思路下的"言說者"話語所宰制,遮蔽了法學作為古老學問的"行動者"知識傳統(tǒng)和實踐技藝,遠離了其作為一門獨特學問的性格和生成基礎。對法學的知識基礎分析一方面證成了法學教育中"行動者"實踐先行的哲學命題,另一方面也揭示:只有在知識論上處理好法學作為"實踐技藝"的獨特性,才能還原法學作為"實踐知識"的古老學問和知識傳統(tǒng),實現(xiàn)現(xiàn)代法學教育從"言說者"到"行動者"的模式變遷,適應社會主義法治國家建設的需要。
[Abstract]:For a long time, Chinese legal education has been dominated by the discourse of "speaker" under the idea of conceptual jurisprudence, which has obscured the knowledge tradition and practical skills of law as an "actor" of ancient learning. The analysis of the knowledge base of law on the one hand proves to be the philosophical proposition of "actor" practice first in law education. On the other hand, it also reveals that only by properly handling the uniqueness of law as "practical skill" in the theory of knowledge, can the ancient knowledge and tradition of law as "practical knowledge" be restored. The mode of modern legal education from "speaker" to "actor" can meet the needs of the construction of socialist country ruled by law.
