【摘要】：本文先分析岳麓書(shū)院藏秦簡(jiǎn)《為獄等狀四種》"尸等捕盜疑購(gòu)"案所見(jiàn)逮捕群盜的獎(jiǎng)賞規(guī)定,然后將此與張家山漢簡(jiǎn)《二年律令》進(jìn)行比較,對(duì)逮捕群盜的獎(jiǎng)賞制度的變遷及其背景進(jìn)行考察。逮捕行"盜"(包括群盜)的外國(guó)人后進(jìn)行獎(jiǎng)賞,戰(zhàn)國(guó)時(shí)期的秦律按照其外國(guó)人是否由他國(guó)動(dòng)員為士兵而區(qū)別,但這種區(qū)別在漢初之前被廢除。這可認(rèn)為是因?yàn)榍貒?guó)在統(tǒng)一六國(guó)時(shí)滅亡秦以外的戰(zhàn)國(guó)諸國(guó)家,已經(jīng)不需要這種區(qū)別。另外,秦律規(guī)定每生捕群盜一人獎(jiǎng)賞黃金十四兩,而《二年律令》規(guī)定賜爵一級(jí)。這可能是對(duì)應(yīng)漢初爵位的通脹現(xiàn)象的,而未必是企圖提高逮捕群盜的獎(jiǎng)賞的。
[Abstract]:This paper first analyzes the reward rules for arresting group thieves, which are found in the case of the case of "the body of the body", and then compares it with the Zhang Jia Shan Han Bamboo slips, "the Law order of two years", in the case of "four kinds of conditions of imprisonment", which are found in Yuelu Academy. This paper investigates the changes and background of the reward system of arresting group theft. After arresting foreigners who commit "theft" (including group theft), the law of Qin Dynasty in the warring States period is distinguished according to whether the foreigners are mobilized as soldiers by other countries. However, this distinction was abolished before the beginning of the Han Dynasty. This may be attributed to the fact that the Qin State did not need this distinction when it destroyed the warring States other than the six Kingdoms. The order of two years provides for the granting of the rank of viscount, which may be in response to the inflation of the title in the early Han Dynasty, not necessarily in an attempt to increase the reward for the arrest of bandits.
