【摘要】：近代科學(xué)技術(shù)的發(fā)展,帶來了醫(yī)學(xué)治療技術(shù)的革新。人體器官移植醫(yī)療技術(shù)的出現(xiàn)和發(fā)展,為廣大器官衰竭病患者帶來了福音�，F(xiàn)代科技的發(fā)展正如一把雙刃劍,有其好的一面,也有其弊端,由于傳統(tǒng)倫理觀念的影響,可用于器官移植手術(shù)的人體器官急缺,給臨床治療的進(jìn)行和醫(yī)療技術(shù)的發(fā)展帶來了障礙；同時(shí),也為我們社會帶來了新問題。由于人體器官的緊缺出現(xiàn)了不少新型的犯罪,而我國還沒有專門法律來規(guī)制這種犯罪,原有法律在新的案件面前顯得蒼白無力。所以,研究人體器官犯罪對我國法律在司法中的適用,未來的立法有莫大裨益,可以為防止犯罪和懲治犯罪提供法律依據(jù)。本文從有關(guān)案例出發(fā),從基本法理方面進(jìn)行分析,用實(shí)例來剖析我國器官移植現(xiàn)狀,我國人體器官移植犯罪的嚴(yán)峻性,我國法律的有關(guān)規(guī)定,借鑒國外成功立法經(jīng)驗(yàn),在案例中探討如何正確適用現(xiàn)有法律來規(guī)制犯罪,并對以后相關(guān)立法加以探討,從法律適用,立法,以及法律解釋等幾個(gè)方面提出建議。
[Abstract]:The development of modern science and technology has brought about the innovation of medical treatment technology and the appearance and development of medical technology of human organ transplantation. The development of modern science and technology, like a double-edged sword, has its good side, but also has its drawbacks, due to the impact of traditional ethics. The acute shortage of human organs, which can be used in organ transplantation, has brought obstacles to the clinical treatment and the development of medical technology. At the same time, it also brings new problems for our society. Due to the shortage of human organs, there are many new types of crime, but there is no special law to regulate this crime in our country. The original law is weak in the face of new cases. Therefore, the study of human organ crime in the application of our law in the administration of justice, the future legislation will be of great benefit. Can provide legal basis for the prevention of crime and punishment of crime. This article from the relevant cases, from the basic legal theory of analysis, with examples to analyze the status quo of organ transplantation in China. The austere nature of the crime of human organ transplantation in our country, the relevant provisions of our law, and the successful legislative experience of foreign countries, this paper discusses how to apply the existing law correctly to regulate the crime in the case. Some suggestions are put forward from the aspects of law application, legislation and legal interpretation.
