【摘要】：《原則宣言》是首屆美國(guó)監(jiān)獄大會(huì)的重要成果。目前,國(guó)內(nèi)外學(xué)界關(guān)于《原則宣言》的研究和分析不僅數(shù)量不多,缺乏系統(tǒng)性,且多是停留在對(duì)二級(jí)文獻(xiàn)的轉(zhuǎn)引層面上,并出現(xiàn)了一些望文生義、以訛傳訛、影響學(xué)習(xí)和研究的問(wèn)題。文章為正其名,在確定了《原則宣言》的真實(shí)原始文本基礎(chǔ)上,對(duì)其完整翻譯并進(jìn)行整理;指出現(xiàn)存問(wèn)題根源所在,并從刑法目的、罪犯改造、監(jiān)獄管理等幾個(gè)方面具體地闡述了《原則宣言》的主要內(nèi)容;從道德理念、制度理念、人的主體性等幾個(gè)層面論述了該文本的重要?dú)v史貢獻(xiàn);首次對(duì)《原則宣言》進(jìn)行了全面的理論研究。
[Abstract]:The Declaration of principles is an important achievement of the first American Prison Congress. At present, the research and analysis of the Declaration of principles in domestic and foreign scholars is not only a small number, but also a lack of systematic. And most of them stay on the level of citation of the secondary literature, and there are a number of problems, which affect learning and research. On the basis of determining the true original text of the Declaration of principles, the complete translation and arrangement are carried out. This paper points out the root of the existing problems, and expounds the main contents of the Declaration of principles from the purposes of criminal law, the reform of criminals, the management of prisons and so on. This paper discusses the important historical contribution of this text from several aspects, such as moral idea, system idea, human subjectivity and so on. A comprehensive theoretical study of the Declaration of principles was carried out for the first time.
