【摘要】：提到為世人所津津樂道的《德國民法典》,我們就不得不提起歷史法學(xué)派,這個曾經(jīng)廣泛而深刻的影響德國甚至大陸法系國家的法學(xué)流派。歷史法學(xué)派對德國民法典的制定產(chǎn)生了重要影響,甚至可以說該法典是該學(xué)派理論發(fā)展的產(chǎn)物。 本文以歷史法學(xué)派對德國民法典的影響為啟示,來探究對中國民法典的影響�？此坡�(lián)系不是那么緊密,但考慮到我國法律的現(xiàn)狀,民法單行法及整個法律體系深受大陸法系尤其是德國法律的影響,這使得這樣的研究變得非常必要和有意義。作為產(chǎn)生優(yōu)秀的《德國民法典》的歷史法學(xué)派,其思想和主張,以及發(fā)展、演變對我們的研究都極具意義。 文章用比較法和立法學(xué)的視角分析了德國和我國的民法典制定。德國民法誕生前的百年論爭和百年后仍然有效地適用,給世人留下了深刻印象。分析其中的歷史素材,汲取對我們有益的東西是本文的出發(fā)點。這樣的角度給我們了全新的理論視野,能讓我們保持清醒的頭腦并可以取人之長,補己之短。同時,文章里始終貫穿歷史法學(xué)派的理論發(fā)展及其演變,以歷史性的眼光來看待百年民法典的制定,并讓我們對中國民法典的制定做出審慎性地考量。 在分析、借鑒德國民法制定的基礎(chǔ)上,歸納了關(guān)于中國民法典制定的不同聲音,并分析了具體的原因,同時指出了繼續(xù)中國民法典制定和研究的必要性。在面對民法典制定這個龐大、浩繁的工作時,選取民法典的制定體系這樣一個最為重要和關(guān)鍵的方向作理論出發(fā)點和突破口,構(gòu)建了中國民法典的大致體系并簡要的做出說明。期冀通過這樣的研究能為我國民法典的制定做出有益的探討
[Abstract]:When we mention the German Civil Code, which has been talked about by the world, we have to mention the school of historical law. This once extensive and profound influence Germany even the continental law system country law school. The history law school Germany civil code formulation has had the important influence. It can even be said that the code is the product of the development of the school's theory. This article takes the influence of the German Civil Code as the inspiration to explore the influence on the Chinese Civil Code. It seems that the relationship is not so close, but considering the current situation of our country's law. The single law of civil law and the whole legal system are deeply influenced by the civil law system, especially the German law, which makes the study of this kind of law become very necessary and meaningful. Its thoughts and ideas, as well as its development, evolution are of great significance to our research. From the perspective of comparative law and legislation, this paper analyzes the formulation of civil code in Germany and China. The German civil law is still valid after a hundred years of controversy before its birth and a hundred years later. It is the starting point of this paper to analyze the historical material and draw on the beneficial things to us. This angle gives us a new theoretical perspective. At the same time, the article always runs through the development and evolution of the historical school of law theory, with a historical perspective to look at the establishment of the century-old civil code. And let us make careful consideration on the formulation of Chinese Civil Code. On the basis of analyzing and drawing lessons from the formulation of German civil law, this paper sums up the different voices about the formulation of Chinese civil code, and analyzes the specific reasons. At the same time, it points out the necessity of making and studying the civil code in China. The most important and key direction of the civil code system is chosen as the theoretical starting point and breakthrough. This paper constructs the general system of China's civil code and gives a brief explanation. It is hoped that this study will be helpful to the formulation of China's civil code.
