【摘要】:黎族傳統(tǒng)社會(huì)契約習(xí)慣法是黎族習(xí)慣法的一部分,其在維護(hù)傳統(tǒng)社會(huì)黎族人民的民商事生活秩序、促進(jìn)黎族地區(qū)的經(jīng)濟(jì)發(fā)展、促進(jìn)黎漢人民的文化交流等方而發(fā)揮了重要作用。黎族傳統(tǒng)社會(huì)契約習(xí)慣法以刻木為信為主要特點(diǎn),反映了傳統(tǒng)社會(huì)黎族人民萬(wàn)物有靈、生靈有信的生活理念。黎族傳統(tǒng)社會(huì)是一個(gè)團(tuán)體本位的社會(huì),黎族傳統(tǒng)社會(huì)契約習(xí)慣法也帶有濃厚的團(tuán)體本位的色彩,黎族傳統(tǒng)社會(huì)的平等、正義等價(jià)值觀念也只有在團(tuán)體本位的基礎(chǔ)上才能得到合理的解讀。黎族偏居海島,受漢文化的影響較小,長(zhǎng)期以來(lái)中央政權(quán)也沒(méi)有在黎族地區(qū)形成有效的統(tǒng)治。黎族傳統(tǒng)社會(huì)是在習(xí)慣法支配下的社會(huì),黎族習(xí)慣法有其內(nèi)生性和原始性,黎族社會(huì)是黎族習(xí)慣法孕育的母體,對(duì)黎族傳統(tǒng)社會(huì)契約習(xí)慣法的探析應(yīng)在充分了解傳統(tǒng)社會(huì)黎族人民的生存環(huán)境的基礎(chǔ)上,在團(tuán)體本位的框架下進(jìn)行深刻的解讀。 本文第一部分對(duì)黎族傳統(tǒng)社會(huì)契約習(xí)慣法的內(nèi)涵和外延進(jìn)行了界定,把黎族傳統(tǒng)社會(huì)契約習(xí)慣法限定在民商事領(lǐng)域進(jìn)行研究。另外對(duì)黎族傳統(tǒng)社會(huì)契約習(xí)慣法的產(chǎn)生、發(fā)展和演變進(jìn)行了闡述,指出黎族傳統(tǒng)社會(huì)契約習(xí)慣法的發(fā)展過(guò)程是一個(gè)不斷漢化的過(guò)程,誠(chéng)實(shí)守信是其價(jià)值內(nèi)核。 本文的第二部分主要涉及黎族傳統(tǒng)社會(huì)契約習(xí)慣法的基本內(nèi)容,包括黎族傳統(tǒng)社會(huì)契約種類、契約形式、契約行為以及黎族傳統(tǒng)社會(huì)契約習(xí)慣法的效力?棠緸樾攀抢枳鍌鹘y(tǒng)社會(huì)契約習(xí)慣法的主要特點(diǎn),刻水為信蘊(yùn)含著黎族人民“萬(wàn)物有靈、生靈有信”的生活理念。黎族傳統(tǒng)社會(huì)契約習(xí)慣法的法律效力較高,其效力來(lái)源不是類似于國(guó)家法的強(qiáng)制,而是來(lái)自黎族人民對(duì)該契約習(xí)慣法的認(rèn)同。 本文的第三部分是筆者總結(jié)出來(lái)的黎族傳統(tǒng)社會(huì)契約習(xí)慣法的理念,包括誠(chéng)信理念、平等理念和團(tuán)體本位理念。黎族傳統(tǒng)社會(huì)契約習(xí)慣法的理念是黎族人民在長(zhǎng)期的生產(chǎn)生活實(shí)踐中理性選擇的結(jié)果,是黎族人民法觀念的一種,它指引著黎族傳統(tǒng)社會(huì)契約習(xí)慣法的實(shí)踐和發(fā)展。 本文的第四部分指出了黎族傳統(tǒng)社會(huì)契約習(xí)慣法的功能及其啟示。黎族傳統(tǒng)社會(huì)契約習(xí)慣法在維護(hù)傳統(tǒng)社會(huì)黎族人民的民商事生活秩序、促進(jìn)黎族社會(huì)發(fā)展、促進(jìn)黎漢人民文化交流和傳承黎族文化方面發(fā)揮了重要作用。黎族傳統(tǒng)社會(huì)契約習(xí)慣法雖沒(méi)有漢族地區(qū)的契約法那樣完備,但其蘊(yùn)含的誠(chéng)信觀、團(tuán)體本位觀對(duì)現(xiàn)代法治建設(shè)還是具有相當(dāng)?shù)膯⑹疽饬x的。面對(duì)現(xiàn)代社會(huì)的誠(chéng)信危機(jī),筆者倡導(dǎo)以黎族傳統(tǒng)社會(huì)契約習(xí)慣法的誠(chéng)信理念為依托,大力進(jìn)行社會(huì)的誠(chéng)信建設(shè)。在個(gè)人利益和公共利益出現(xiàn)矛盾時(shí),筆者提倡樹立社會(huì)本位的利益觀,解決利益沖突,構(gòu)建和諧社會(huì)。
[Abstract]:Li traditional social contract customary law is a part of Li customary law, which maintains the order of the people's civil and commercial life in the traditional society and promotes the economic development of Li nationality area. The traditional social contract law of Li nationality is characterized by wood-engraving as the main feature, which reflects the animosity of the people of Li nationality in traditional society. The traditional society of Li nationality is a society based on group, and the customary law of contract of the traditional society of Li nationality also has the color of group standard, and the equality of the traditional society of Li nationality. Justice and other values can only be interpreted reasonably on the basis of the group standard. The Li nationality lives on the island and is less influenced by the Han culture. For a long time, the central government has not formed an effective rule in the region of Li nationality. The traditional society of Li nationality is dominated by customary law, and the customary law of Li nationality has its intrinsic and primitive character. Li society is the mother of Li customary law. The analysis of Li traditional social contract customary law should be based on a full understanding of the living environment of Li people in traditional society. In the framework of the group-based interpretation of the profound. The first part of this paper defines the connotation and extension of the traditional customary law of social contract of Li nationality. The traditional customary law of social contract of Li nationality is limited to the field of civil and commercial affairs. In addition, the generation, development and evolution of customary law of traditional social contract of Li nationality are expounded. It is pointed out that the development process of the traditional social contract customary law of Li nationality is a process of continuous Sinicization, and honesty and trustworthiness are the core of its value. The second part of this paper mainly deals with the basic content of the customary law of the traditional social contract of Li nationality, including the type and form of the traditional social contract of Li nationality. Contract behavior and the effect of the customary law of the Li nationality traditional social contract. Engraving wood as the trust is the main characteristic of the customary law of the Li nationality traditional social contract. The traditional customary law of social contract of Li nationality has a higher legal effect, not from the compulsion of the national law, but from the identification of the people of Li nationality to the customary law of the contract. The third part of this paper is the author summed up the traditional concept of customary law of the Li social contract, including the concept of good faith. The concept of customary law of the traditional social contract of Li nationality is the result of rational choice of Li people in the long-term practice of production and life, and it is a kind of concept of law of Li people. It guides the practice and development of the customary law of the Li nationality's traditional social contract. The 4th part of this paper points out the function and enlightenment of the customary law of Li nationality's traditional social contract. The customary law of Li nationality's traditional social contract maintains the order of the people's civil and commercial life in the traditional society and promotes the development of the Li nationality's society. The traditional social contract law of Li nationality is not as complete as the contract law of Han nationality, but it contains the concept of good faith. In the face of the crisis of honesty in modern society, the author advocates to rely on the concept of good faith of the traditional social contract law of Li nationality. When there are contradictions between personal interests and public interests, the author advocates the establishment of a society-oriented view of interest, the resolution of conflicts of interests, and the construction of a harmonious society.
