【摘要】：《狄奧多西法典》是羅馬法史上的第一部官方法典,是西方法律編纂史上的重要里程碑,西方法律史從此進入法典時代。狄奧多西二世皇帝進行法典編纂的目的主要是為了應對當時法律淵源混亂冗雜的情況,為裁判官提供簡便的裁判規(guī)范索引。該法典并沒有實質(zhì)性地創(chuàng)制法律,僅僅是收集、篩選和整理了君士坦丁皇帝以來的諭令,并以主題與時序疊加的順序進行排列,同時追求規(guī)范、簡短、清晰的表述。整部法典以具有一般性效力的皇帝諭令和告示為主要法律淵源,排除了法學理論和批復等法源形式,且多處禁止法學家對法律進行解釋,體現(xiàn)了立法者希望通過法典編纂維護政權統(tǒng)治的意圖。該法典在一定程度上緩和了當時司法混亂的狀況,以法典的形式將公法、私法的所有規(guī)范以一定的邏輯體系編排在一起,是古羅馬后古典時期立法作品的代表之作。
[Abstract]:Theodussi Code is the first official code in the history of Roman law and an important milestone in the history of western legal compilation. The history of western law entered the era of code. Emperor Theodore II's purpose of codification was mainly to deal with the confusion of the legal sources at that time. The Code does not substantially create laws, but merely collects, sifts, and arranges orders from the Emperor Constantine. It is arranged in the order of the superposition of the subject and the time sequence, while pursuing the norm, brief and clear expression. The whole code takes the decree and notice with general effect as the main legal source. It excludes the legal source form such as legal theory and approval, and prohibits jurists from interpreting the law in many places. It reflects the intention of legislator to protect regime rule through codification. To some extent, the code alleviates the judicial confusion at that time and sets public law in the form of code. All the norms of private law, arranged in a certain logical system, are the representative of the legislative works of the post-Roman period.
