【摘要】：伴隨我國(guó)經(jīng)濟(jì)的高速發(fā)展,人與環(huán)境間的矛盾突顯。從刑事法的角度對(duì)環(huán)境污染犯罪進(jìn)行規(guī)制意義重大。通過(guò)對(duì)日本刑法中關(guān)于環(huán)境污染犯罪的規(guī)定進(jìn)行總結(jié)與歸納,并與我國(guó)刑法中有關(guān)環(huán)境污染犯罪的規(guī)定進(jìn)行比較。發(fā)現(xiàn)我國(guó)環(huán)境犯罪立法中存在的諸多問(wèn)題,并提出切實(shí)可行的立法建議。 文章在對(duì)我國(guó)與日本的環(huán)境犯罪概念進(jìn)行界定的基礎(chǔ)上,回顧了兩國(guó)環(huán)境犯罪立法的發(fā)展,并對(duì)兩國(guó)刑事立法的現(xiàn)狀特征進(jìn)行了歸納和評(píng)析,發(fā)現(xiàn)我國(guó)刑事立法對(duì)環(huán)境犯罪的規(guī)定呈現(xiàn)專節(jié)懲治環(huán)境犯罪、拓寬了環(huán)境犯罪適用范圍、增加了環(huán)境犯罪中單位的責(zé)任、加大了環(huán)境犯罪的處罰等特點(diǎn)。并從法律淵源角度講,從刑法典到特別刑法和附屬刑法,對(duì)日本刑事法中環(huán)境犯罪的規(guī)定進(jìn)行梳理。 在前述歸納總結(jié)中日兩國(guó)環(huán)境犯罪刑事立法的基礎(chǔ)上,發(fā)現(xiàn)我國(guó)環(huán)境犯罪立法存在立法體系不科學(xué)、保護(hù)范圍過(guò)窄、罪狀描述不清、無(wú)危險(xiǎn)犯的規(guī)定、環(huán)境犯罪刑罰種類單一等問(wèn)題。發(fā)現(xiàn)日本環(huán)境犯罪立法注重罰金刑等財(cái)產(chǎn)刑、處罰法人、設(shè)立危險(xiǎn)犯、對(duì)環(huán)境犯罪的認(rèn)定考慮故意或過(guò)失等優(yōu)點(diǎn)。 最后,提出完善我國(guó)環(huán)境犯罪立法的建議,確定了預(yù)防性、范圍適度性、具體與抽象相結(jié)合、前瞻性等原則。并具體的提出了應(yīng)規(guī)定罪刑明確而獨(dú)立的非刑事法律規(guī)范、應(yīng)使各法條的量刑標(biāo)準(zhǔn)統(tǒng)一化等立法建議。
[Abstract]:With the rapid development of our economy. From the angle of criminal law, it is of great significance to regulate environmental pollution crimes. Through the summary and induction of the provisions of Japanese criminal law on environmental pollution crimes. Compared with the provisions of our country's criminal law on environmental pollution crime, the author finds out many problems existing in the legislation of environmental crime in our country, and puts forward some feasible legislative suggestions. On the basis of defining the concept of environmental crime in China and Japan, this paper reviews the development of the legislation of environmental crime in the two countries, and summarizes and comments on the characteristics of the present situation of the criminal legislation of the two countries. It is found that the provisions of our country's criminal legislation on environmental crimes present a special section to punish environmental crimes, widen the scope of application of environmental crimes, and increase the responsibility of units in environmental crimes. From the angle of legal source, from the criminal code to the special criminal law and the subsidiary criminal law, the article combs the provisions of the environmental crime in the Japanese criminal law. On the basis of summing up the criminal legislation of environmental crime in China and Japan, we find that the legislation system is unscientific, the scope of protection is too narrow, the description of crime is not clear, and there is no dangerous crime. It is found that the legislation of environmental crime pays attention to the property penalty such as fine punishment, punishes the law person, establishes the dangerous crime, and considers intentional or negligent in the determination of the environmental crime. Finally, it puts forward some suggestions to perfect the legislation of environmental crime in our country, and determines the preventive, moderate scope, concrete and abstract combination. The author also puts forward some legislative suggestions, such as the clear and independent non-criminal legal norms of crime and punishment, and the unification of sentencing standards of various articles of law, and so on.
