【摘要】：信訪是中國源遠(yuǎn)流長的歷史長河中的一種重要社會現(xiàn)象,是具有中國特色的一項(xiàng)政治制度,信訪興衰對中國的民主和法治建設(shè)有著重要的意義。信訪制度作為我國公民參與政治的重要途徑,是人民群眾行使民主的重要形式,是公民救濟(jì)的重要方式,而信訪作為中國特有的政治、法律和社會問題,近年來越來越引起了理論界的高度關(guān)注。伴隨我國社會改革的不斷深入,深層次的矛盾不斷顯露,再加上信訪制度本身的設(shè)計(jì)上的不合理性產(chǎn)生了政治參與的職能萎縮而權(quán)力救濟(jì)的職能過度膨脹的發(fā)展趨勢,給信訪制度敲響了警鐘,改革勢在必行。在大力建設(shè)法治國家的今天,信訪是取是舍,成為一個(gè)歷史性的話題擺在了我們面前。 要解決這一問題,我們首先要認(rèn)識到信訪制度在法治環(huán)境下的定位,認(rèn)識到法治是信訪制度賴以存在的制度環(huán)境,而正是法治的低迷成就了信訪的發(fā)達(dá)。我國現(xiàn)行的信訪制度表明,信訪在保護(hù)弱勢群體利益,提供民意表達(dá)渠道、促進(jìn)立法、改善執(zhí)法、改善司法和制度創(chuàng)新方面有著不可替代的優(yōu)勢,但存在整體框架不合理、處理方式不理想、缺乏程序性、信訪工作者工作水平有待提高等很多因素。
[Abstract]:Petition is an important social phenomenon in the long history of China and a political system with Chinese characteristics. The rise and fall of petition is of great significance to the construction of democracy and the rule of law in China. As an important way for citizens to participate in politics, the petition system is an important form for the masses to exercise democracy and an important way for citizens to remedy. As a special political, legal and social problem in China, letters and visits have attracted more and more attention in the theoretical circle in recent years. With the deepening of social reform in our country, deep-seated contradictions have been revealed. In addition, the irrational design of the letter and visit system has caused the shrinking of the function of political participation and the excessive expansion of the function of power relief, which has sounded the alarm to the system of letters and visits. It is imperative to reform. Today, when we are building a country ruled by law, letters and visits are accepted or rejected, and become a historic topic in front of us. To solve this problem, we should first of all recognize the position of petition system in the environment of rule of law, and realize that the rule of law is the institutional environment on which the petition system depends. It is the low level of the rule of law that has made the petition developed. The current petition system in China shows that the petition is protecting the interests of the vulnerable groups, providing channels for public opinion expression, promoting legislation, and improving law enforcement. The improvement of judicial and institutional innovation has irreplaceable advantages, but there are many factors, such as unreasonable overall framework, unsatisfactory handling methods, lack of procedure, and the work level of petition workers need to be improved.
