【摘要】：在執(zhí)行工作中,不可避免地會(huì)出現(xiàn)變通執(zhí)行依據(jù)的情形。變通執(zhí)行依據(jù)是指在民事執(zhí)行時(shí),基于各種原因,尤其是執(zhí)行案件的需要,對(duì)其所依據(jù)的生效裁判文書(shū)認(rèn)定的事實(shí)、內(nèi)容、結(jié)果等予以一定范圍內(nèi)的變通。包括采納新的事實(shí)依據(jù)、擴(kuò)展裁判文書(shū)的內(nèi)容、變通執(zhí)行三種形式。變通的原則包括合法性原則、關(guān)聯(lián)性原則和程序性原則。對(duì)于變通執(zhí)行依據(jù)制度的構(gòu)建,則應(yīng)置于新一輪審執(zhí)分離的大背景之下,明確這一權(quán)限的行使部門,探索分段管理與垂直管理的基本構(gòu)架,并不斷優(yōu)化相應(yīng)變通程序。
[Abstract]:In the execution work, there will inevitably appear the situation of the alternative execution basis. The alternative execution basis refers to the need for various reasons, especially the execution case, when the civil execution is carried out. The facts, contents and results of the effective adjudication documents on which they are based should be modified to a certain extent, including the adoption of new factual basis and the expansion of the contents of the adjudicative documents. The principle of flexibility includes the principle of legality, the principle of relevance and the principle of procedure. Define the department of exercising this authority, explore the basic framework of subsection management and vertical management, and constantly optimize the corresponding workaround.
