【摘要】：在學(xué)校教育過(guò)程中,教師有管理和指導(dǎo)學(xué)生的權(quán)利。對(duì)于學(xué)生的失范行為,在勸誡不奏效的情況下,教師可以選擇懲戒的方式來(lái)教育管理學(xué)生。但是教師是否存在懲戒學(xué)生的權(quán)利、教師擁有怎樣的懲戒權(quán)、不同國(guó)家教師懲戒權(quán)的行使有無(wú)差異?本研究從上述問(wèn)題入手,對(duì)教師懲戒權(quán)行使的理論和實(shí)踐研究進(jìn)行梳理,通過(guò)問(wèn)卷和訪談?wù){(diào)查的研究方法,探索我國(guó)中小學(xué)教師懲戒權(quán)在認(rèn)識(shí)、方式、頻率、阻力及效果上的使用現(xiàn)狀。并通過(guò)比較研究的方法探析國(guó)外教師懲戒權(quán)行使的經(jīng)驗(yàn)教訓(xùn)及對(duì)我國(guó)的啟示。在此基礎(chǔ)上發(fā)現(xiàn)我國(guó)中小學(xué)教師懲戒權(quán)行使異化存在“濫用”和“缺失”兩種情況,同時(shí)政策法律、管理機(jī)制以及文化教育方面產(chǎn)生的問(wèn)題也是我國(guó)教師懲戒權(quán)行使實(shí)現(xiàn)規(guī)范化、合理化亟待解決的問(wèn)題。
[Abstract]:In the process of school education, teachers have the right to manage and guide students.In the case of failure of persuasion, teachers can choose the way of discipline to educate and manage students.But does the teacher have the right to discipline the students, what kind of disciplinary power does the teacher have, and whether there are differences in the exercise of the right to discipline in different countries?This research begins with the above questions, combs the theoretical and practical research on the exercise of teachers' disciplinary power, and explores the understanding, mode and frequency of teachers' disciplinary power in primary and secondary schools through the research methods of questionnaire and interview investigation.Resistance and effectiveness of the use of the status quo.Through the method of comparative study, this paper probes into the experience and lessons of the exercise of foreign teachers' disciplinary power and its enlightenment to our country.On this basis, it is found that there are two kinds of cases of "abuse" and "lack" of dissimilation in the exercise of disciplinary power of primary and secondary school teachers in our country, as well as the policy and law.The problems arising from the management mechanism and culture and education are also the problems to be solved urgently in the exercise of teachers' disciplinary power in China.
