【摘要】：正義對(duì)社會(huì)制度來說非常重要,是社會(huì)制度的首要價(jià)值。千百年來,人們對(duì)這一問題不斷探索,把實(shí)現(xiàn)制度正義作為矢志不渝的社會(huì)理想和價(jià)值目標(biāo)。羅馬共和制作為世界制度史上一顆璀璨的名星,其蘊(yùn)含的正義理論對(duì)后世西方各國(guó)的制度設(shè)計(jì)產(chǎn)生了深遠(yuǎn)的影響,也對(duì)我國(guó)的制度建設(shè)有理論啟示。近年來,理論界多從政治學(xué)、歷史學(xué)的視角來研究羅馬共和制正義,但鮮少有學(xué)者從唯物史觀的角度來研究,所以研究相對(duì)不足,不夠深入,有很大的發(fā)展空間,因此,從唯物史觀來研究羅馬共和制正義,有長(zhǎng)遠(yuǎn)的理論意義,對(duì)我國(guó)的制度建設(shè)和核心價(jià)值觀的構(gòu)建有較大的現(xiàn)實(shí)意義。本文運(yùn)用了文獻(xiàn)分析、邏輯與歷史相統(tǒng)一的方法,從唯物史觀的視角對(duì)羅馬共和制正義進(jìn)行了分析研究,得出了意義和啟示。論文的主體分為三部分:第一部分,從制度正義概念出發(fā),深入剖析了制度正義的基本結(jié)構(gòu)、主要內(nèi)容,進(jìn)而闡述西方制度正義思想的歷史演進(jìn)、馬克思制度正義的基本觀點(diǎn);第二部分,闡述了羅馬共和制及其正義性,羅馬民主制度的發(fā)展過程,在理論闡述的基礎(chǔ)上,揭示了羅馬共和制正義設(shè)計(jì)理念的唯物史觀蘊(yùn)涵,并從唯物史觀的視角出發(fā)定位羅馬共和制正義的歷史影響;第三部分,首先,闡述了羅馬共和制正義對(duì)當(dāng)代西方民主制度發(fā)展的積極影響,包括:對(duì)當(dāng)代西方三權(quán)分立體制的影響,對(duì)當(dāng)代西方行省管理制度的影響。其次,借鑒羅馬共和制正義對(duì)西方民主制的影響,闡釋了羅馬共和制正義對(duì)當(dāng)代中國(guó)制度建設(shè)的立法、行政、司法啟示。最后,闡釋了羅馬共和制正義對(duì)中國(guó)的現(xiàn)實(shí)意義,對(duì)當(dāng)代中國(guó)核心價(jià)值觀之“公正”、“平等”、“自由”、“民主”、“法治”構(gòu)建的借鑒作用。本文的新意及特色之處在于:本文從唯物史觀的視角來研究羅馬共和制正義,來分析它的唯物史觀蘊(yùn)涵,從唯物史觀的角度給它一個(gè)歷史定位,角度新穎。羅馬從王政到共和,走過了一個(gè)曲折的道路,在平民與貴族的斗爭(zhēng)中,生產(chǎn)力不斷發(fā)展,平民經(jīng)濟(jì)實(shí)力不斷增強(qiáng),政治地位也隨之提高,正是這種矛盾運(yùn)動(dòng),推動(dòng)羅馬共和制正義不斷發(fā)展完善,進(jìn)而對(duì)西方民主制度產(chǎn)生影響,間接對(duì)我國(guó)制度建設(shè)產(chǎn)生啟示,對(duì)我國(guó)核心價(jià)值觀構(gòu)建產(chǎn)生借鑒,從而對(duì)推進(jìn)我國(guó)制度正義建設(shè)有深遠(yuǎn)的理論意義和實(shí)踐意義。
[Abstract]:Justice is very important to the social system and the primary value of the social system.For thousands of years, people have been constantly exploring this problem, regard the realization of system justice as the unswerving social ideal and value goal.The creation of the Roman Republic is a brilliant star in the history of the world system. The theory of justice contained in it has a profound influence on the institutional design of the later western countries, and also has theoretical implications for the institutional construction of our country.In recent years, the theorists have mostly studied the Roman Republican justice from the perspective of politics and history, but few scholars have studied it from the angle of historical materialism, so the research is relatively insufficient, not deep enough, and has a lot of room for development.The study of Roman Republican justice from historical materialism has long-term theoretical significance and has great practical significance for the construction of our country's system and core values.Using the method of literature analysis, logic and history, this paper analyzes and studies the justice of Roman republic from the perspective of historical materialism, and draws the significance and enlightenment.The main body of the paper is divided into three parts: the first part, from the concept of institutional justice, in-depth analysis of the basic structure of institutional justice, the main content, and then elaborated the historical evolution of western institutional justice thought, Marx's basic point of view of institutional justice;The second part expounds the Roman republic system and its justice, the development process of the Roman democratic system, on the basis of the theoretical elaboration, reveals the historical materialism implication of the Roman republic justice design idea.And from the perspective of historical materialism to locate the historical impact of Roman Republican justice. The third part, first of all, expounds the positive impact of Roman Republican justice on the development of contemporary western democratic system.Including: the influence on the contemporary western system of separation of powers, the influence on the modern western province management system.Secondly, draw lessons from the influence of Roman Republican justice on western democracy, and explain the legislative, administrative and judicial enlightenment of Roman Republican justice to contemporary Chinese system construction.Finally, it explains the realistic significance of Roman Republican justice to China, and the reference function of the construction of "justice", "equality", "freedom", "democracy" and "rule of law" for contemporary Chinese core values.The new ideas and features of this paper lie in: this article studies the justice of Roman republic system from the perspective of historical materialism, analyzes its historical materialism implication, and gives it a historical orientation from the angle of historical materialism.Rome has gone through a tortuous road from the royal government to the republic. In the struggle between the common people and the aristocrats, the productive forces continued to develop, the economic strength of the common people continued to increase, and the political status also increased. It is precisely this kind of contradictory movement.Promote the development and perfection of Roman Republican justice, and then influence the western democratic system, indirectly enlighten the construction of our country's system, and draw lessons from the construction of our core values.Therefore, it has profound theoretical and practical significance to promote the construction of institutional justice in our country.
