【摘要】：康德將人在國家中的的權(quán)利與義務(wù)建立在所有人的理性同意基礎(chǔ)上。因此,他的法哲學(xué)與政治哲學(xué)不依賴于意志論,不依賴于社會成員的倫理訴求,也不依賴于個體的理性自律。借助于人的理性,我們發(fā)現(xiàn)人們對于國家權(quán)力的服從是一種自然的義務(wù)。理性因而是自由公民之間達(dá)成的共識。在此意義上,康德的法哲學(xué)與政治哲學(xué)不是盧梭學(xué)說的簡單延續(xù),而是其光大與拓展�？档聦W(xué)說中不但有盧梭因素,同時蘊含著對于霍布斯與洛克學(xué)說主題的回應(yīng)。
[Abstract]:Kant based his rights and obligations in the state on the rational consent of all.Therefore, his philosophy of law and politics does not depend on the volition, the ethical demands of the members of the society, or the rational self-discipline of the individual.With the help of human rationality, we find that obedience to state power is a natural obligation.Reason is thus a consensus among free citizens.In this sense, Kant's philosophy of law and politics is not a simple continuation of Rousseau's theory, but its light and expansion.There is not only Rousseau factor in Kant's theory, but also a response to Hobbes and Locke.
